Claim Rejections - 35 USC § 102
The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action:
A person shall be entitled to a patent unless –
(a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale, or otherwise available to the public before the effective filing date of the claimed invention.
Claim(s) 1, 14, 22, and 23 is/are rejected under 35 U.S.C. 102(a)(1) as being disclosed by Burk et al. (2023/0374802).
Burk et al. discloses the invention including:
Claim 1; a drive section 1 comprising a wheel 12; a blade positioning assembly 26 coupled to the drive section and comprising a rotatable blade holder 70; a control assembly comprising a first actuator assembly 30 configured to move the blade holder, and a first position sensor (see para. 0015) configured to send position signals indicative of the position of the blade holder.
Claim 14; a controller 19 configured to receive first position signals from the first position sensor indicative of the position of the blade holder and transmit actuator control signals to the first actuator assembly.
Claim 22; wherein said actuator assembly comprises an actuator selected from a group consisting of hydraulic linear actuators 254, hydraulic rotary actuators, electro-mechanical linear actuators, and electro-mechanical rotary actuators.
Claim 23; wherein said floor stripper is a ride-on floor stripper (see para. 0052).
Allowable Subject Matter
Claims 24-70 are allowed.
Claims 2-13 and 15-21 are objected to as being dependent upon a rejected base claim, but would be allowable if rewritten in independent form including all of the limitations of the base claim and any intervening claims.
