Office Action

§102 §112
DETAILED ACTION Notice of Pre-AIA or AIA Status The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . Election/Restrictions Applicant’s election without traverse of Species A in the reply filed on 01-Jul-2026 is acknowledged. Claims 5-20 are withdrawn. Claim Rejections - 35 USC § 112 The following is a quotation of 35 U.S.C. 112(b): (b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention. The following is a quotation of 35 U.S.C. 112 (pre-AIA ), second paragraph: The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention. Claims 1-4 are rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant), regards as the invention. Regarding independent claim 1, the phrase “the sensor assembly rotates with the rotation shaft in response to a change in an angle between the rotation shaft and the rotor” is indefinite because it is unclear what is structurally required. For example, the specification consistently refers to a change in an angle between the rotation shaft and the sensor assembly, but not the rotor (see e.g. US 2025/0214555, ¶¶ 0008-0011, 0088, 0099, 0104, 0105, 0121, 0122, 0140, 0149, 0150, 0174). As such, it is unclear what structure is required to permit the sensor assembly to rotate with the rotation shaft in response to a change in an angle between the rotation shaft and the rotor. Claim Rejections - 35 USC § 102 The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action: A person shall be entitled to a patent unless – (a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale, or otherwise available to the public before the effective filing date of the claimed invention. Claim 1 is rejected under 35 U.S.C. 102(a)(1) as being anticipated by Ansoo Yoon (KR 2022 0005911) (machine translation attached). Regarding independent claim 1, Ansoo Yoon discloses a hydraulic supply (see machine translation, ¶ 0001; FIGS. 1-6) comprising: a motor (100) coupled to a modulator block (10) (see FIG. 1) and having a stator (110) and a rotor (120); a rotation shaft (210) coupled to the rotor to rotate with the rotor (see ¶ 0021); and a sensor assembly (500) coupled to the rotation shaft to measure rotation frequency of the rotation shaft (see ¶ 0038), wherein the sensor assembly rotates with the rotation shaft in response to a change in an angle between the rotation shaft and the rotor (see e.g. FIG. 1, the sensor assembly would continue to rotate with the rotation shaft in the event of a change in an angle between the rotation shaft and the rotor due to excessive loads, for example). Allowable Subject Matter Claims 2-4 would be allowable if rewritten to overcome the rejection(s) under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), 2nd paragraph, set forth in this Office action and to include all of the limitations of the base claim and any intervening claims. Conclusion Any inquiry concerning this communication or earlier communications from the examiner should be directed to NICHOLAS J LANE whose telephone number is (571)270-5988.
