Notice of Pre-AIA or AIA Status The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . Claim Rejections - 35 USC § 103 The following is a quotation of 35 U.S.C. 103 which forms the basis for all obviousness rejections set forth in this Office action: A patent for a claimed invention may not be obtained, notwithstanding that the claimed invention is not identically disclosed as set forth in section 102, if the differences between the claimed invention and the prior art are such that the claimed invention as a whole would have been obvious before the effective filing date of the claimed invention to a person having ordinary skill in the art to which the claimed invention pertains. Patentability shall not be negated by the manner in which the invention was made. Claim(s) 1, 2 and 9 are rejected under 35 U.S.C. 103 as being unpatentable over Rao et al (US9352656) in view of KR101000431 and JP7501441 Rao et al discloses an oil temperature control device comprising a detector configured to detect state information of vehicle including a motor , calculator configured to estimate cooling oil temperature of motor based on state information, (see Col. 4 lines 55 to Col. 5, line 54 and fig 4 under detailed description) , estimate of temp oil based on temp of coil. Rao et al lacks disclosing speed of oil pump , and difference in coil and oil temperature . KR101000431 discloses rpm of oil pump see abstract and JP7501441 discloses difference in coil temperature and oil temperature , see abstract . It would have been obvious to one of ordinary kill in the art before the effective filing date of the claimed invention to combine oil temperature control of Rao et al with speed of oil pump of KR 101000431 and difference of coil temperature and oil temperature ofJP7501441 for improved control. Claim(s) 2 is rejected under 35 U.S.C. 103 as being unpatentable over Rao et la and KR101000431 and JP7501441 as applied to claims 1,9 above, and further in view of KR101807517. As disclosed above lacks back emf . KR101807517 discloses back emf in abstract . It would have been obvious to one of ordinary skill in the art before the effective filing date of the claimed invention to combine oil temperature control of Rao et al and KR101000431 and JP7501441 with back emf of KR101807517 for improved control. Claims 3-8,10-11 are objected to as being dependent upon a rejected base claim, but would be allowable if rewritten in independent form including all of the limitations of the base claim and any intervening claims. Prior art does not disclose stop state to idle state and oil temperature less than predetermined reference .
