Election/Restrictions
Applicant’s election without traverse of Group II, claims 5-15 in the reply filed on 09 June 2026 is acknowledged.
Claims 1-5 withdrawn from further consideration pursuant to 37 CFR 1.142(b) as being drawn to a nonelected sensor device, there being no allowable generic or linking claim. Election was made without traverse in the reply filed on 09 June 2026.
Claim Rejections - 35 USC § 112
The following is a quotation of the first paragraph of 35 U.S.C. 112(a):
(a) IN GENERAL.—The specification shall contain a written description of the invention, and of the manner and process of making and using it, in such full, clear, concise, and exact terms as to enable any person skilled in the art to which it pertains, or with which it is most nearly connected, to make and use the same, and shall set forth the best mode contemplated by the inventor or joint inventor of carrying out the invention.
The following is a quotation of the first paragraph of pre-AIA 35 U.S.C. 112:
The specification shall contain a written description of the invention, and of the manner and process of making and using it, in such full, clear, concise, and exact terms as to enable any person skilled in the art to which it pertains, or with which it is most nearly connected, to make and use the same, and shall set forth the best mode contemplated by the inventor of carrying out his invention.
Claims 5-15 are rejected under 35 U.S.C. 112(a) or 35 U.S.C. 112 (pre-AIA ), first paragraph, as failing to comply with the written description requirement. The claim(s) contains subject matter which was not described in the specification in such a way as to reasonably convey to one skilled in the relevant art that the inventor or a joint inventor, or for applications subject to pre-AIA 35 U.S.C. 112, the inventor(s), at the time the application was filed, had possession of the claimed invention. Claims 5 and 9 are the current independent claims pending in this application. Both claims 5 and 9 require in part: “…..monitors a fault of the pipe through signal processing for performing correlation analysis and noise removal on a reflected signal generated by the ultrasonic guided signal being reflected at an arbitrary point of the pipe.” However, there are two terms in the claim that are not truly defined in the specification as filed. First, the specification fails to disclose specifically what correlation analysis is being performed. While the specification does disclose that a cross correlation is performed and that correlation between first and second projection functions are done, what exactly said correlation being done actually is not disclosed. Further, there is no disclosure how the noise removal is actually done, it is simply stated that noise removal is done. Since the correlation analysis and the noise removal are pivotal in the fault monitoring, yet not disclosed, then it is not clear that the applicant actually had possession of the invention as claimed at the time the application was filed. Since claims 5 and 9 lack an adequate written description, then claims 6-8 and 10-15, which depend either directly or indirectly from one of claims 5 or 9, lack an adequate written description as well.
Conclusion
The present rejection does not contain a prior art rejection, but that is in not meant as an indication of any allowable subject matter in the present application. The current 35 USC 112 issues in the claims actually present an issue with performing an adequate and proper search of the claims in relation to the prior art as it is difficult at this time to determine precisely what the invention is truly doing and how. Should the applicant amend the claims to resolve these issues, then a new search will be conducted and if at that time similar prior art is found and a prior art rejection is made, then that rejection can be made final if the rejection is deemed to be made in view of the newly amended claims.
