Claim Rejections - 35 USC § 102
The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action:
A person shall be entitled to a patent unless –
(a)(2) the claimed invention was described in a patent issued under section 151, or in an application for patent published or deemed published under section 122(b), in which the patent or application, as the case may be, names another inventor and was effectively filed before the effective filing date of the claimed invention.
Claim(s) 1, 3, 8, 10-14 is/are rejected under 35 U.S.C. 102(a)(2) as being anticipated by Hansen et al (US 8,415,568)
Re claim 1, Hansen et al disclose an electromagnetic wave shielding material (20),
wherein the electromagnetic wave shielding material is a laminate (col. 10, line 32) in which both outermost layers are metal layers (56, 58)(col. 14, lines 16-17) and one or more magnetic layers (50)(col. 14, lines 1-7) are provided, and the electromagnetic wave shielding material has a penetrating part (66, 68) that penetrates from a position on one side surface of the laminate to a position on the other side surface thereof and the penetrating part is a through-hole (Fig 2).
Re claim 3, wherein the through-hole is provided in a portion other than the metal layers as both outermost layers (Fig 2).
Re claim 8 wherein the laminate includes, in the following order; a metal layer (56) as one outermost layer, a magnetic layer (50), and a metal layer (58) as the other outermost layer.
Re claim 10, an electronic component (46) comprising:the electromagnetic wave shielding material (Fig 2).
Re claim 11, wherein the electromagnetic wave shielding material is disposed at a position at which a direction of a magnetic field is orthogonal to a penetration direction of the penetrating part (Fig 1).
Re claim 12, an electronic apparatus comprising: the electromagnetic wave shielding material (Fig 2).
Re claims 13, 14, wherein the electromagnetic wave shielding material is disposed at a position at which a direction of a magnetic field is orthogonal to a penetration direction of the penetrating part (Fig 1).
Claim Rejections - 35 USC § 103
The following is a quotation of 35 U.S.C. 103 which forms the basis for all obviousness rejections set forth in this Office action:
A patent for a claimed invention may not be obtained, notwithstanding that the claimed invention is not identically disclosed as set forth in section 102, if the differences between the claimed invention and the prior art are such that the claimed invention as a whole would have been obvious before the effective filing date of the claimed invention to a person having ordinary skill in the art to which the claimed invention pertains. Patentability shall not be negated by the manner in which the invention was made.
Claim(s) 7 is/are rejected under 35 U.S.C. 103 as being unpatentable over Hansen et al (US 8,415,568).
The teaching as discussed above does not disclose wherein a width of the penetrating part is 1.0 mm or less.
It would have been obvious to one of ordinary skill in the art at the time the invention was made to select the specific size of the penetrating part for shielding a particular frequency, since such a modification would have involved a mere change in the size of a component. A change in size is generally recognized as being within the level of ordinary skill in the art. In re Rose, 105 USPQ 237 (CCPA 1955).
Allowable Subject Matter
The indicated allowability of claim 2, 3 is withdrawn in view of the newly discovered reference(s) to Hansen et al (US 8,415,568).
Claims 4, 9, 14-23 allowed.
