The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA .
Priority
The instant application is a continuation-in-part of US Application No. 17/040865 (now US Patent No. 12,005,080 B2), filed 23 September 2020, which is a national stage entry under 35 USC 371 of PCT/CN2019/079576, filed 25 March 2019. Acknowledgment is made of Applicant’s claim for foreign priority under 35 USC 119(a)-(d) to Application No. CN201810251875.7, filed 26 March 2018. Receipt is acknowledged of the certified copy of papers filed, in a non-English language, required by 37 CFR 1.55 within parent Application No. 17/040865, filed on 23 September 2020.
Election/Restrictions
Applicant's election with traverse of Group I encompassing claims 1-11 is acknowledged, as Applicant has timely traversed the restriction (election) requirement in the reply filed on 26 May 2026. The traversal is on the grounds that there would not be a serious burden on the Examiner to search the two restricted groups, as they appear to be part of an overlapping search area. See Page 2 of the Response filed 26 May 2026. This is not found persuasive, as the Examiner respectfully submits that there would be an undue burden on the Examiner to search the two restricted groups for the reasons of record set forth on Pages 3-4 of the Restriction requirement filed 15 April 2026. Therefore, the requirement is still deemed proper and is thereby made FINAL.
Furthermore, Applicant's election with traverse of LRP6 as the species is acknowledged, as Applicant has timely traversed the restriction (election) requirement in the reply filed on 26 May 2026. The traversal is on the grounds that it is unnecessary to elect between LRP5 and LRP6, as the intracellular regions of each LRP exhibits the same functional effect on the biological activity of the genetically modified immune cell. See Pages 3-4 of the Response filed 26 May 2026, as well as Examples 9-13 of the instant disclosure. In response, the Examiner finds this persuasive and withdraws the species election requirement.
Consequently, claims 12-20 are withdrawn from further consideration pursuant to 37
CFR 1.142(b), as being drawn to a nonelected invention, there being no allowable generic or linking
claim. Prosecution on the merits commences for claims 1-11.

Claim Interpretation
The instant claims recite “low density lipoprotein receptor-associated protein” whereas the instant Specification filed 13 August 2024 recites the “low density lipoprotein receptor-related protein” within Paragraph [0135]. For purposes of prosecution, these terms will be interpreted as being synonymous.
Furthermore, claim 7 recites the limitation “…or the amino acid sequence having at least 80% homology thereof”. This is interpreted as meaning “80% homology of any one of SEQ ID NOs:
22, 24, 26 or 28”. Likewise, claim 8 regarding SEQ ID NOs: 21, 23, 25, and 27 will be interpreted as such.
In addition, under the broadest reasonable interpretation of claim 11, the optional limitation is not required.
Claim Rejections - 35 USC § 112
The following is a quotation of the first paragraph of 35 U.S.C. 112(a):
(a) IN GENERAL. —The specification shall contain a written description of the invention, and of the manner and process of making and using it, in such full, clear, concise, and exact terms as to enable any person skilled in the art to which it pertains, or with which it is most nearly connected, to make and use the same, and shall set forth the best mode contemplated by the inventor or joint inventor of carrying out the invention.
The following is a quotation of the first paragraph of pre-AIA 35 U.S.C. 112:
The specification shall contain a written description of the invention, and of the manner and process of making and using it, in such full, clear, concise, and exact terms as to enable any person skilled in the art to which it pertains, or with which it is most nearly connected, to make and use the same, and shall set forth the best mode contemplated by the inventor of carrying out his invention.
Claims 1-4 and 9-11 are rejected under 35 U.S.C. 112(a) or 35 U.S.C. 112 (pre-AIA ), first paragraph, as failing to comply with the written description requirement. The claims contain subject matter which was not described in the Specification in such a way as to reasonably convey to one skilled in the relevant art that the inventor or a joint inventor, or for applications subject to pre-AIA 35 U.S.C. 112, the inventors, at the time the application was filed, had possession of the claimed invention.
The claims under rejection are directed to a genetically modified immune cell comprising a low density lipoprotein receptor-associated protein or a fragment thereof, wherein the low density lipoprotein receptor-associated protein or fragment thereof comprises an intracellular region of the low density lipoprotein receptor-associated protein (LRP).
Thus, to satisfy the written description aspect of 35 U.S.C. 112(a) for a claimed group – or genus – of fragments, it must be clear that: (1) the identifying characteristics of the claimed fragments have been disclosed, e.g., structure or other physical and/or chemical properties, by functional characteristics coupled with a known or disclosed cor-relation between function and structure, or by a com-bination of such identifying characteristics; or (2) a representative number of species within the genus must be disclosed. See MPEP 2163, Eli Lilly, 119 F.3d at 1568, 43 USPQ2d at 1406; In re Baird, 16 F.3d 380, 382, 29 USPQ2d 1550, 1552 (Fed. Cir. 1994).
In giving the term ‘fragment [of a low density lipoprotein receptor-associated protein] comprising an intracellular region of the LRP’ its broadest reasonable interpretation, the number and types of proteins which can be considered a fragment of a low density lipoprotein receptor-associated protein is extraordinarily great, and can be interpreted to even include a single amino acid of the intracellular domain. Applicant’s disclosure of such fragments is limited to a single defined sequence for a truncated LRP5 and a truncated LRP6, therefore there is limited disclosure of acceptable fragments of a low density lipoprotein receptor-associated protein comprising an intracellular region of the LRP.
Regarding disclosure of identifying characteristics of the claimed fragments, Applicant has amended the claim to necessitate the low density lipoprotein receptor-associated protein or fragment thereof to comprise an intracellular region of the low density lipoprotein receptor-associated protein, as supported by Example 5 of the instant disclosure. However, Applicant has not identified any particular core function (along with a correlation between function and a specific conserved structure) of the low density lipoprotein receptor-associated protein which must be shared by all fragments thereof; and thus one of ordinary skill in the art would not immediately envisage all fragments of the low density lipoprotein receptor-associated protein, as currently claimed. Therefore, Applicant has not disclosed the identifying characteristics of the claimed fragments.
Regarding disclosure of a representative number of species within the genus, a review of the specification shows that Applicant has disclosed one acceptable fragment each for LRP5 and LRP6, as dictated in SEQ ID NOs: 28 and 24, respectively. Disclosure of a single species does not constitute a representative number for such a broad genus as is encompassed by the breadth of ‘fragments of a low density lipoprotein receptor-associated protein comprising an intracellular region of the LRP’. Therefore, Applicant has not disclosed a representative number of species, as would be required to support description and to show possession of the entire genus.
Thus, one of ordinary skill in the art, in looking to the instant Specification, would not be able to determine that Applicant was in possession of the invention, as claimed, at the time the invention was made. Accordingly, the claims are considered to lack sufficient written description and are properly rejected under 35 USC 112(a).
It is of note that instant claims 5-8 are not included within the rejection of record, as they specifically define the sequence with which the low density lipoprotein receptor-associated protein or fragment thereof must comprise.

(b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention.

The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention.
Claims 1-11 are rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant), regards as the invention.
Regarding claim 1: The instant claim recites the limitation "the fragment thereof" in Line 3. There is insufficient antecedent basis for this limitation in the claim, as there is no prior recitation of a low density lipoprotein receptor-associated protein fragment within the instant claim. See MPEP § 2173.05(e). Therefore, the metes and bounds of the claim cannot be determined, thus rendering the scope of the claim indefinite.
The instant claim further recites the limitation "the low density lipoprotein receptor-associated protein 5" in Line 5. There is insufficient antecedent basis for this limitation in the claim, as there is no prior recitation of a low density lipoprotein receptor-associated protein 5 within the instant claim. See MPEP § 2173.05(e). Therefore, the metes and bounds of the claim cannot be determined, thus rendering the scope of the claim indefinite.
Instant claims 2-11 are either dependent upon or fully incorporate the limitations of independent claim 1, thus rendering them indefinite as well.
Appropriate correction is required.
Regarding claim 2: The instant claim defines the genetically modified immune cell as having “one or more properties selected from the group consisting of: 1) a promoted proliferation of the immune cell; 2) a promoted production of a memory cell; 3) an inhibited differentiation of the immune cell to a regulatory T cell (Treg); 4) an enhanced release of a cytokine from the immune cell; or 5) an enhanced ability of the immune cell to kill a tumor, compared with an unmodified immune cell” (emphasis added). Claim language defined by a Markush grouping requires selection from a closed group "consisting of" the alternative members. See MPEP § 2117(I): Id. at 1280, 67 USPQ2d at 1196. The recitation of “or” indicates that the Markush group is open, thus rendering the metes and bounds of the claim indefinite.
Appropriate correction is required.
Double Patenting
The nonstatutory double patenting rejection is based on a judicially created doctrine grounded in public policy (a policy reflected in the statute) so as to prevent the unjustified or improper timewise extension of the “right to exclude” granted by a patent and to prevent possible harassment by multiple assignees. A nonstatutory double patenting rejection is appropriate where the conflicting claims are not identical, but at least one examined application claim is not patentably distinct from the reference claim(s) because the examined application claim is either anticipated by, or would have been obvious over, the reference claim(s). See, e.g., In re Berg, 140 F.3d 1428, 46 USPQ2d 1226 (Fed. Cir. 1998); In re Goodman, 11 F.3d 1046, 29 USPQ2d 2010 (Fed. Cir. 1993); In re Longi, 759 F.2d 887, 225 USPQ 645 (Fed. Cir. 1985); In re Van Ornum, 686 F.2d 937, 214 USPQ 761 (CCPA 1982); In re Vogel, 422 F.2d 438, 164 USPQ 619 (CCPA 1970); In re Thorington, 418 F.2d 528, 163 USPQ 644 (CCPA 1969).
A timely filed terminal disclaimer in compliance with 37 CFR 1.321(c) or 1.321(d) may be used to overcome an actual or provisional rejection based on nonstatutory double patenting provided the reference application or patent either is shown to be commonly owned with the examined application, or claims an invention made as a result of activities undertaken within the scope of a joint research agreement. See MPEP § 717.02 for applications subject to examination under the first inventor to file provisions of the AIA as explained in MPEP § 2159. See MPEP § 2146 et seq. for applications not subject to examination under the first inventor to file provisions of the AIA . A terminal disclaimer must be signed in compliance with 37 CFR 1.321(b).
The filing of a terminal disclaimer by itself is not a complete reply to a nonstatutory double patenting (NSDP) rejection. A complete reply requires that the terminal disclaimer be accompanied by a reply requesting reconsideration of the prior Office action. Even where the NSDP rejection is provisional the reply must be complete. See MPEP § 804, subsection I.B.1. For a reply to a non-final Office action, see 37 CFR 1.111(a). For a reply to final Office action, see 37 CFR 1.113(c). A request for reconsideration while not provided for in 37 CFR 1.113(c) may be filed after final for consideration. See MPEP §§ 706.07(e) and 714.13.

Claims 1-11 are rejected on the ground of nonstatutory double patenting as being unpatentable over claims 1-6 of U.S. Patent No. 12,005,080 B2. It is of note that the instant application is a CONTINUATION-IN-PART of the now patent.
Although the claims at issue are not identical, they are not patentably distinct from each other
because the patent claims either anticipate or render obvious the instant claims. In addition, the prohibition of nonstatutory Double Patenting Rejections under USC 1.121 does not apply for applications filed as continuation-in-parts, even if a Restriction Requirement was made in the parent Application (MPEP § 804.01 (E)).
Patent claim 1 is directed to a genetically modified human immune cell, wherein the genetic modification up-regulates an expression of a low density lipoprotein receptor-associated protein or fragment thereof in the genetically modified immune cell,
wherein the low density lipoprotein receptor-associated protein is low density lipoprotein receptor-associated protein 6 or the low density lipoprotein receptor-associated protein 5,
wherein the low density lipoprotein receptor-associated protein or fragment thereof comprises an intracellular region of the low density lipoprotein receptor-associated protein, and
wherein the low density lipoprotein receptor-associated protein or fragment thereof comprises an amino acid sequence as set forth in any one of SEQ ID NO: 22, 24, 26, and 28, or an amino acid sequence having at least 80% homology thereof.
As the sequences of patent SEQ ID NOs: 22, 24, 26, and 28 are identical to instant SEQ ID NOs: 22, 24, 26, and 28, patent claim 1 therefore anticipates the limitations of instant claims 1 and 5-7. See sequence alignment at end of document.
With that, patent claims 2-6 are each substantially identical to and thus anticipate instant claims 3-4, 8, and 10. See sequence alignment at end of document regarding SEQ ID NOs: 21, 23, 25, and 27 in instant claim 8.
In addition, since the genetically modified human immune cell of patent claim 1 is structurally identical to the genetically modified immune cell of the instant claim, the genetically modified human immune cell will inherently have one or more of the properties recited in instant claim 2.
Likewise, the ordinary artisan would have recognized that the genetically modified human immune cell of patent claim 1 could be any one of a T cell, an NK cell, a B cell, a dendritic cell, or a macrophage, as those are well-known immune cells within the art. See Paragraph [0018] of the instant Specification. This therefore renders obvious the genetically modified immune cell instant claim 10.
Lastly, the ordinary artisan also would have recognized that the genetically modified human immune cell of patent claim 1 can be comprised within a composition, as that is a product variant of the patent claim. This therefore renders obvious the composition of instant claim 11.
