Claim Rejections - 35 USC § 102
The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action:
A person shall be entitled to a patent unless –
(a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale, or otherwise available to the public before the effective filing date of the claimed invention.
Claims 1 and 10 are rejected under 35 U.S.C. 102(a)(1) as being anticipated by Xie (CN 113587056-cited in applicant’s IDS). The Examiner notes that US 2024/0240779 is used as an English translation in this claim analysis.
Regarding independent claim 1, Xie teaches a ceiling lamp mounting structure comprising a bottom frame assembly (Fig. 1, Element 1; ¶ [0039]), a sliding assembly (Fig. 7, Element 51; ¶ [0054]), and a connection assembly (Fig. 1, Element 2; ¶ [0039]), and wherein the bottom frame assembly is fixed on a mounting wall (Abstract), the connection assembly is fixedly connected with a lamp main body (¶ [0039]), the connection assembly is detachably connected with the bottom frame assembly through the sliding assembly (¶ [0053]), the sliding assembly comprises a sliding rail (Fig. 7, Element 511; ¶ [0054]) and a sliding rod (Fig. 7, Element 512; ¶ [0054]), the sliding rail is fixedly connected with the bottom frame assembly, one end of the sliding rod is movably connected with the sliding rail, and the other end of the sliding rod is rotatably connected with the connection assembly (¶ [0054]).
Regarding independent claim 10, Xie teaches a ceiling lamp comprising a lamp main body (¶ [0039]) and a ceiling lamp mounting structure, wherein the ceiling lamp mounting structure comprises a bottom frame assembly (Fig. 1, Element 1; ¶ [0039]), a sliding assembly (Fig. 7, Element 51; ¶ [0054]), and a connection assembly (Fig. 1, Element 2; ¶ [0039]), and wherein the bottom frame assembly is fixed on a mounting wall (Abstract), the connection assembly is fixedly connected with a lamp main body (¶ [0039]), the connection assembly is detachably connected with the bottom frame assembly through the sliding assembly (¶ [0053]), the sliding assembly comprises a sliding rail (Fig. 7, Element 511; ¶ [0054]) and a sliding rod (Fig. 7, Element 512; ¶ [0054]), the sliding rail is fixedly connected with the bottom frame assembly, one end of the sliding rod is movably connected with the sliding rail, and the other end of the sliding rod is rotatably connected with the connection assembly (¶ [0054]); and the lamp main body comprises a chassis (Fig. 1, Element 3; ¶ [0039]), the chassis comprises a bottom surface (Fig. 6, Element 31; ¶ [0051]) and a side wall (Fig. 6, Element 32; ¶ [0051]) extending from the bottom surface in a direction away from the lamp main body, the side wall and the bottom surface delimit a receiving cavity (Fig. 6), the ceiling lamp mounting structure is received in the receiving cavity, and the bottom frame assembly of the ceiling lamp mounting structure is fixedly connected with the side wall of the chassis (Fig. 1).
Allowable Subject Matter
Claims 2-9 are objected to as being dependent upon a rejected base claim, but would be allowable if rewritten in independent form including all of the limitations of the base claim and any intervening claims.
The following is a statement of reasons for the indication of allowable subject matter: Regarding claim 2, the prior art of record neither shows or suggests a ceiling lamp mounting structure comprising, in addition to other limitations of the claim, a sliding rail including a first receiving portion and a second receiving portion, and the second receiving portion is formed by extending the first receiving portion to a direction away from the bottom frame assembly, a projection area of a connection portion between the first receiving portion, and the second receiving portion on the sliding rail being smaller than a projection area of the first receiving portion on the sliding rail.
Due to their dependencies upon claim 2, claims 3-9 are also allowable.
Conclusion
The prior art made of record and not relied upon is considered pertinent to applicant's disclosure. Feng (US 2022/0299198) teaches a lamp with a lamp holder including a first shell and a light source module.
