Claim 15 is withdrawn from further consideration pursuant to 37 CFR 1.142(b), as being drawn to a nonelected invention, there being no allowable generic or linking claim.
An action on the merits of claims 1-14 is contained herein.
Priority
This application claims priority to U.S. provisional patent application no. 63/526,567,which was filed July 13, 2023. Benefit for the provisional application is not accorded since subject matter disclosed within the instant application is not supported (e.g. scope of variables R1-4). The claims in a U.S. application are entitled to the benefit of a foreign priority date or the filing date of a provisional application if the corresponding foreign application or provisional application supports the claims in the manner required by 35 U.S.C. 112(a) or pre-AIA 35 U.S.C. 112, first paragraph. In re Ziegler, 992 F.2d 1197, 1200, 26 USPQ2d 1600, 1603 (Fed. Cir. 1993); Kawaiv.Metlesics, 480 F.2d 880, 178 USPQ 158 (CCPA 1973); In re Gosteli, 872 F.2d 1008, 10 USPQ2d 1614 (Fed. Cir. 1989).
Information Disclosure Statement
The examiner has considered the references cited in the information disclosure statement filed of record.
Specification
Applicant is reminded of the proper content of an Abstract of the Disclosure, see MPEP 608.01(b).
In chemical patent abstracts for compounds or compositions, the general nature of the compound or composition should be given as well as its use, e.g., "The compounds are of the class of alkyl benzene sulfonyl ureas, useful as oral anti-diabetics." Exemplification of a species could be illustrative of members of the class. For processes, the type reaction, reagents and process conditions should be stated, generally illustrated by a single example unless variations are necessary.
It is recommended that the structure of Formula IV be inserted into the abstract to accurately illustrate the claimed invention. Additionally the disclosure is objected to due to misspellings (e.g. page 29, [0086], “bromtetrazolate”). Correction is required and wherever appropriate.
Claim Objections
Claims 1-14 are objected to because of the following informalities:
In claim 1 and claims which depend from it for variables R5,6 the term “amine” should recite “amino”. Additionally there should be dashes incorporated before the following groups to readily indicate site of attachment:

In claim 4, “Phenyl" should more appropriately read "phenyl". Claims should only begin with a capital letter and end with a period. See MPEP 608.01(m).
Applicant is advised that should claim 6 be found allowable, claim 5 will be objected to under 37 CFR 1.75 as being a substantial duplicate thereof. When two claims in an application are duplicates or else are so close in content that they both cover the same thing, despite a slight difference in wording, it is proper after allowing one claim to object to the other as being a substantial duplicate of the allowed claim. See MPEP § 608.01(m). In the instant case, these claims only limit claim 1 with respect to variable R4 being selected from hydrogen and embrace the same claim scope.
Claim Rejections - 35 USC § 112
The following is a quotation of 35 U.S.C. 112(b):
(b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention.
The following is a quotation of 35 U.S.C. 112 (pre-AIA ), second paragraph:
The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention.
Claims 1-14 are rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor, or for pre-AIA the applicant regards as the invention.
In the instant claim 1, formula II recites the following embodiments for variables R2-4 initially:

. Then the formula III recites the following for these variables which include new embodiments such as “azide” and “heterocyclyl”:

. The resulting difference creates ambiguity as it is unclear how these groups eventually are incorporated into the later formula III. Thus the claim and claims dependent on it which do not rectify the issue are indefinite.
Claim 11 recites the language “reaction can be carried out” which is unclear. What does Applicant intend by the language “can be”? Are Applicants suggesting the language “optionally” or something else? See In re Zletz, 13 USPQ2d 1320, 1322, “An essential purpose of patent examination is to fashion claims that are precise, clear, correct and unambiguous.”
Claim Rejections - 35 USC § 112
The following is a quotation of 35 U.S.C. 112(d):
(d) REFERENCE IN DEPENDENT FORMS.—Subject to subsection (e), a claim in dependent form shall contain a reference to a claim previously set forth and then specify a further limitation of the subject matter claimed. A claim in dependent form shall be construed to incorporate by reference all the limitations of the claim to which it refers.
The following is a quotation of 35 U.S.C. 112 (pre-AIA ), fourth paragraph:
Subject to the [fifth paragraph of 35 U.S.C. 112 (pre-AIA )], a claim in dependent form shall contain a reference to a claim previously set forth and then specify a further limitation of the subject matter claimed. A claim in dependent form shall be construed to incorporate by reference all the limitations of the claim to which it refers.
Claims 3, 4, and 7 are rejected under 35 U.S.C. 112(d) or pre-AIA 35 U.S.C. 112, 4th paragraph, as being of improper dependent form for failing to further limit the subject matter of the claim upon which it depends, or for failing to include all the limitations of the claim upon which it depends. These claims do not further limit claim 1 with respect to variables R5,6 being selected from “heterocyclyl” since claim 1 does not set forth this possibility.
Applicant may cancel the claim(s), amend the claim(s) to place the claim(s) in proper dependent form, rewrite the claim(s) in independent form, or present a sufficient showing that the dependent claim(s) complies with the statutory requirements.
Claim Rejections - 35 USC § 102
The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action:
A person shall be entitled to a patent unless –
(a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale or otherwise available to the public before the effective filing date of the claimed invention.
Claims 1-14 are rejected under 35 U.S.C. 102(a)(1) as being anticipated over Yount et al. Chem. Eur. J. 2024, 30, e202400661 (first published online 4/3/2024):

Yount et al. teach the preparation of Applicant’s elected species using the claimed process (see page 6, Scheme 3a, for reaction of compound of formula I with formula II to afford precursor 13a wherein R = H, conditions of reaction using MeCN as the solvent and tetraethylammonium tetrazolate as the electrolyte described at page 5, right column, and preparation of the final compound at page 9, example 15a with UV cyclization conditions described at page 8, left column). Thus, the claims are anticipated.
Conclusion
No claims are allowed.
