Office Action

§103
Notice of Pre-AIA or AIA Status The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . Claim Rejections - 35 USC § 103 The following is a quotation of 35 U.S.C. 103 which forms the basis for all obviousness rejections set forth in this Office action: A patent for a claimed invention may not be obtained, notwithstanding that the claimed invention is not identically disclosed as set forth in section 102, if the differences between the claimed invention and the prior art are such that the claimed invention as a whole would have been obvious before the effective filing date of the claimed invention to a person having ordinary skill in the art to which the claimed invention pertains. Patentability shall not be negated by the manner in which the invention was made. Claim(s) 1 and 20 are rejected under 35 U.S.C. 103 as being unpatentable over WO2022/093932 cited by Applicant in view of EP3731408. WO2022/093932 discloses power tool comprising tool housing , motor within tool housing (405) fig 4, a battery receptacle arranged to be coupled to battery pack having a rated capacity (410 fig 4), power switch circuit disposed between battery receptacle and motor (450 fig 4), a controller that controls power switch circuit to drive motor whin controlled is congaed to ( 400 fig 4), determine or receive a pack id associated with rated capacity of battery pack ( see abstract ). WO2022/093932 lacks disclosing braking profile and apply brake to motor . EP3731408 discloses a braking profile for braking motor and apply brake to motor in accordance with set braking profile upon detection of event associated with stoppage of motor , see second paragraph after description of fig 44 . It would have been obvious to one of ordinary skill in the art before the effective filing date of claimed invention to combine the power tool of WO2022/093932 with braking profile of EP3731408 for improved control. Claim(s) 13 is rejected under 35 U.S.C. 103 as being unpatentable over WO2022/093932 in view of EP3731408 as applied to claims 1,20 above, and further in view of WO2020/251838 . As disclosed above lacks regenerative current threshold . WO2022/251838 discloses regenerative current threshold , see Advantage . It would have been obvious to one of ordinary skill in the art to combine the power tool and braking profile of WO2022/092932 with EP3731408 and regenerative current threshold of WO2020/251838 for improved control. Allowable Subject Matter Claims 2-12,13-19 are objected to as being dependent upon a rejected base claim, but would be allowable if rewritten in independent form including all of the limitations of the base claim and any intervening claims. Prior art does not disclose regenerative current is less for first battery pack than for second battery pack, and soft braking segment including periods , and coasting .
