DETAILED ACTION The present application is being examined under the pre-AIA first to invent provisions. The instant first office action is in response to communication filed on 06/22/2026. Claim 1-20 is pending of which claims 1 and 11 are the base independent claim. Response to Arguments Applicant’s arguments with respect to claim(s) 1-20 have been considered but are moot because the new ground of rejection does not rely on any reference applied in the prior rejection of record for any teaching or matter specifically challenged in the argument. Claim Rejections - 35 USC § 112 The following is a quotation of the first paragraph of 35 U.S.C. 112(a): (a) IN GENERAL.—The specification shall contain a written description of the invention, and of the manner and process of making and using it, in such full, clear, concise, and exact terms as to enable any person skilled in the art to which it pertains, or with which it is most nearly connected, to make and use the same, and shall set forth the best mode contemplated by the inventor or joint inventor of carrying out the invention. The following is a quotation of the first paragraph of pre-AIA 35 U.S.C. 112: The specification shall contain a written description of the invention, and of the manner and process of making and using it, in such full, clear, concise, and exact terms as to enable any person skilled in the art to which it pertains, or with which it is most nearly connected, to make and use the same, and shall set forth the best mode contemplated by the inventor of carrying out his invention. Claims 1-20 are rejected under 35 U.S.C. 112(a) or 35 U.S.C. 112 (pre-AIA ), first paragraph, as failing to comply with the written description requirement. The claim(s) contains subject matter which was not described in the specification in such a way as to reasonably convey to one skilled in the relevant art that the inventor or a joint inventor, or for applications subject to pre-AIA 35 U.S.C. 112, the inventor(s), at the time the application was filed, had possession of the claimed invention. The subject matter which was not described in the specification is “transmitting, via a first downlink (DL) frequency band paired with a first uplink (UL) frequency band, configuration information for a mobile device, the configuration information identifying a second DL frequency band for DL reception by the mobile device, wherein the second DL frequency band is not paired with any dedicated UL frequency band”. A quick review of the specification shows, see fig.21, 2102 & see para.0125, a DL signal is received via a first DL frequency band of the plurality of DL frequency bands for DL transmission, the DL signal including DL-UL frequency-band association information…, para.0128, In one embodiment, based on the decoded DL-UL frequency-band association information, the first UL frequency band is associated with a second DL frequency band of the plurality of DL frequency bands. The RF circuitry of the mobile device may then be configured to operate in the second DL frequency band for DL data reception, see also para.0129, based on the decoded DL-UL frequency-band association information, a second UL frequency band of the plurality of UL frequency bands may be associated with a second DL frequency band of the plurality of DL frequency bands. The RF circuitry of the mobile device may then be configured to operate in the second DL frequency band for DL data reception and in the second UL frequency band for UL data transmission Thus, the subject matter of “the second DL frequency band is not paired with any dedicated UL frequency band” is not described as claimed since the first UL frequency band/ second UL frequency band is associated/paired/linked with a second DL frequency. Conclusion Applicant's amendment necessitated the new ground(s) of rejection presented in this Office action. Accordingly, THIS ACTION IS MADE FINAL. See MPEP § 706.07(a). Applicant is reminded of the extension of time policy as set forth in 37 CFR 1.136(a). A shortened statutory period for reply to this final action is set to expire THREE MONTHS from the mailing date of this action. In the event a first reply is filed within TWO MONTHS of the mailing date of this final action and the advisory action is not mailed until after the end of the THREE-MONTH shortened statutory period, then the shortened statutory period will expire on the date the advisory action is mailed, and any nonprovisional extension fee (37 CFR 1.17(a)) pursuant to 37 CFR 1.136(a) will be calculated from the mailing date of the advisory action. In no event, however, will the statutory period for reply expire later than SIX MONTHS from the mailing date of this final action. The prior art made of record and not relied upon is considered pertinent to applicant's disclosure. Following prior arts are related to the present claimed invention: Cave et al (US 20110105112) teaches, see para.0050, A combination of the above two embodiments may be implemented in case where multiple DL carriers are configured for measurement gaps and at least one DL carrier has an associated UL carrier and at least one DL carrier does not. FIG. 4 shows an example DL and UL carrier configuration with measurement gaps on the DL carrier in accordance with an alternative embodiment. In this example, a WTRU is configured with three DL carriers and two UL carriers. The WTRU includes three receivers and all receivers are active to process the three DL carriers. The first DL carrier is associated with the first UL carrier, the second DL carrier is associated with the second UL carrier, and the third DL carrier is unpaired. The measurement gaps are configured on the second and third DL carriers, and the WTRU may not transmit during the measurement gaps on the second UL carrier, which is assocated with the second DL carrier. Applicant is encouraged to submit a written authorization for Internet communications (PTO/SB/439, http://www.uspto.gov/sites/default/files/documents/sb0439.pdf) in the instant patent application to authorize the examiner to communicate with the applicant via email.
