DETAILED ACTION
Notice of Pre-AIA or AIA Status
The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA .
Specification
Amendments to the Abstract and specifications filed on 7/07/2026 have been entered.
Response to Arguments
Applicant’s arguments filed on 07/07/2026, with respect to claim(s) 1-7 and 9-14, have been considered but are moot because the new ground of rejection does not rely on any reference applied in the prior rejection of record for any teaching or matter specifically challenged in the argument.
Claim Rejections - 35 USC § 112
The following is a quotation of the first paragraph of 35 U.S.C. 112(a):
(a) IN GENERAL.—The specification shall contain a written description of the invention, and of the manner and process of making and using it, in such full, clear, concise, and exact terms as to enable any person skilled in the art to which it pertains, or with which it is most nearly connected, to make and use the same, and shall set forth the best mode contemplated by the inventor or joint inventor of carrying out the invention.
The following is a quotation of the first paragraph of pre-AIA 35 U.S.C. 112:
The specification shall contain a written description of the invention, and of the manner and process of making and using it, in such full, clear, concise, and exact terms as to enable any person skilled in the art to which it pertains, or with which it is most nearly connected, to make and use the same, and shall set forth the best mode contemplated by the inventor of carrying out his invention.
Claims 1-7, and 9-14, are rejected under 35 U.S.C. 112(a) or 35 U.S.C. 112 (pre-AIA ), first paragraph, as failing to comply with the written description requirement. The claim(s) contains subject matter which was not described in the specification in such a way as to reasonably convey to one skilled in the relevant art that the inventor or a joint inventor, or for applications subject to pre-AIA 35 U.S.C. 112, the inventor(s), at the time the application was filed, had possession of the claimed invention.
Amended claim 1, line 13, recites “a third image” (independent claims 13 and 14, recites similar language). However, the specification does not describes “a third image”. Though, Figs. 6A, 8A, 10A, and 13-14, shows multiple images but does not show which image corresponds to claimed “third image” neither specification describes a third image nor drawings show how said third image is being displayed. Hence, the specification and the drawings are silent with respect to claimed “a third image”. Therefore claims 1, and 13-14 (and their respective dependent claims) raises the issue of new matter and the specification of the pending application does not have support for the amended portion of the claims.
Examiner’s Note: Any indication of allowable subject matter is being held in abeyance pending response to the rejection under 35 U.S.C 112(a).
Pertinent Priori Art
The prior art made of record and not relied upon is considered pertinent
to applicant's disclosure.
Nakamura (US PGPUB 2022/0270272 A1) reference discloses a measuring system comprising a processor including hardware. The processor calculates first information with reference to a marker provided in a measurement target. The first information indicates the position and attitude of a camera. The camera measures depth information indicating a depth to each point of the measurement target, along with an image of the measurement target. The processor extracts second shape information from first shape information based on the first information. The first shape information indicates a three-dimensional shape of the measurement target. The second shape information indicates a three-dimensional shape corresponding to an imaging range of the camera. The processor compares the depth information with the second shape information. The processor calculates second information based on a result of the comparison between the depth information and the second shape information. The second information indicates the position and the attitude of the camera with a higher precision than the first information. The processor causes a display to display information relating to the result of the comparison between the depth information and the second shape information based on the second information.
Wakai (US PGPUB 2021/0372783 A1) reference discloses an imaging section to capture an image of a measurement element without adjustment of a rotation angle of a measurement object performed by a user. A control unit identifies a reference rotation angle during measurement, and calculates a measurement angle to measure a measurement element based on a relative rotation angle with respect to the reference rotation angle stored in advance. The control unit controls a rotation unit such that a rotation angle of the rotation unit becomes the measurement angle. The control unit executes a process of measuring a dimension of the measurement element based on a measurement object image captured by an imaging section when the rotation angle of the rotation unit becomes the measurement angle.
Conclusion
Applicant's amendment necessitated the new ground(s) of rejection presented in this Office action. Accordingly, THIS ACTION IS MADE FINAL. See MPEP § 706.07(a). Applicant is reminded of the extension of time policy as set forth in 37 CFR 1.136(a).
A shortened statutory period for reply to this final action is set to expire THREE MONTHS from the mailing date of this action. In the event a first reply is filed within TWO MONTHS of the mailing date of this final action and the advisory action is not mailed until after the end of the THREE-MONTH shortened statutory period, then the shortened statutory period will expire on the date the advisory action is mailed, and any nonprovisional extension fee (37 CFR 1.17(a)) pursuant to 37 CFR 1.136(a) will be calculated from the mailing date of the advisory action. In no event, however, will the statutory period for reply expire later than SIX MONTHS from the mailing date of this final action.
