DETAILED ACTION Notice of Pre-AIA or AIA Status The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . Drawings The drawings are objected to under 37 CFR 1.83(a). The drawings must show every feature of the invention specified in the claims. Therefore, the Electrode plate transfer device comprising: a base part; a rotation providing part ; a linear driving part ; and a transfer part . must be shown or the feature(s) canceled from the claim(s). No new matter should be entered. Corrected drawing sheets in compliance with 37 CFR 1.121(d) are required in reply to the Office action to avoid abandonment of the application. Any amended replacement drawing sheet should include all of the figures appearing on the immediate prior version of the sheet, even if only one figure is being amended. The figure or figure number of an amended drawing should not be labeled as “amended.” If a drawing figure is to be canceled, the appropriate figure must be removed from the replacement sheet, and where necessary, the remaining figures must be renumbered and appropriate changes made to the brief description of the several views of the drawings for consistency. Additional replacement sheets may be necessary to show the renumbering of the remaining figures. Each drawing sheet submitted after the filing date of an application must be labeled in the top margin as either “Replacement Sheet” or “New Sheet” pursuant to 37 CFR 1.121(d). If the changes are not accepted by the examiner, the applicant will be notified and informed of any required corrective action in the next Office action. The objection to the drawings will not be held in abeyance. Claim Rejections - 35 USC § 112 Claims 1-20 are rejected under 35 U.S.C. 112(a) or 35 U.S.C. 112 (pre-AIA ), first paragraph, because the specification, while being enabling for an Electrode plate transfer device does not reasonably provide enablement for How base part and rotation providing part are connected and aligned with a linear driving part and transfer part.. The specification does not enable any person skilled in the art to which it pertains, or with which it is most nearly connected, to show Figure 2 works and Figures 1 and 10-12 work but not how the two work together the invention commensurate in scope with these claims. There is not one drawing or description of how the first part of claim 1 is connected to the second part. Part of claim 1. An electrode plate transfer device comprising: a base part; a rotation providing part mounted on the base part and configured to provide a rotational force; Part 2 of Claim 1 a linear driving part linearly movable by the rotation providing part; and a transfer part connected to the linear driving part and supported by the base part so as to move an electrode plate. The method of claim 20 has the same problems on how it works. Claim Rejections - 35 USC § 102 In the event the determination of the status of the application as subject to AIA 35 U.S.C. 102 and 103 (or as subject to pre-AIA 35 U.S.C. 102 and 103) is incorrect, any correction of the statutory basis (i.e., changing from AIA to pre-AIA ) for the rejection will not be considered a new ground of rejection if the prior art relied upon, and the rationale supporting the rejection, would be the same under either status. The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action: A person shall be entitled to a patent unless – (a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale, or otherwise available to the public before the effective filing date of the claimed invention. Claim(s) 1-2 and 20 is/are rejected in view of the 112 rejections and rejected under 35 U.S.C. 102(a1) as being anticipated by Kitajima 5513977. Kitajima discloses the claimed invention was recited in the claims as shown below: 1. An electrode plate transfer device comprising: a base part 4; a rotation providing part 13 mounted on the base part and configured to provide a rotational force; a linear driving part 6 linearly movable by the rotation providing part; and a transfer part 2 connected to the linear driving part and supported by the base part so as to move an electrode plate. 2. The electrode plate transfer device as claimed in claim 1, wherein the base part comprises: a base fixing part 4; a base adjustment part 12 mounted on the base fixing part; and a base support part 15 of which a height is adjustable by the base adjustment part and which supports the transfer part. 20. An electrode plate transfer method comprising: detecting an electrode plate using a detector; holding the electrode plate, using a transfer part, when the detector detects the electrode plate; and driving a rotation providing part and providing power thereby after the transfer part holds the electrode plate, wherein, when the rotation providing part rotates, a linear driving part engaged with the rotation providing part moves in a left-right direction, and the transfer part moves, the transfer part comprises a transfer case supported by a base part to move in the left-right direction, a plurality of transfer pulleys rotatably mounted on the transfer The method is the natural use of the claimed invention. case, a transfer belt which is wound around the transfer pulleys, moves in an endless orbit and of which a portion is fixed to the base part, and a transfer holder which is mounted on the transfer belt and holds and moves the electrode plate, and the electrode plate is moved by the transfer case and the transfer belt. Allowable Subject Matter Allowable subject matter could not be determined since the drawings, specification and claims did not explain what the invention is supposed to be. Claims not rejected under art were not rejected due to the art not reading on the words not because these were allowable. Conclusion The prior art made of record and not relied upon is considered pertinent to applicant's disclosure. The 892 form discloses prior art being made of record.
