The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA .
Claim Rejections - 35 USC § 102
In the event the determination of the status of the application as subject to AIA 35 U.S.C. 102 and 103 (or as subject to pre-AIA 35 U.S.C. 102 and 103) is incorrect, any correction of the statutory basis (i.e., changing from AIA to pre-AIA ) for the rejection will not be considered a new ground of rejection if the prior art relied upon, and the rationale supporting the rejection, would be the same under either status.
The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action:
A person shall be entitled to a patent unless –
(a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale, or otherwise available to the public before the effective filing date of the claimed invention.
Claim(s) 13-16 and 18-20 is/are rejected under 35 U.S.C. 102(a)(1) as being anticipated by Kim et al. (hereinafter “Kim”, US Pat No. 2004/0141566).
As per claim 13, Kim disclosed remote radio head (see fig. 1, 12) configured to communicate with a mobile unit (see fig. 1, 16) over a wireless communication link (see fig. 1, 14), the RRH comprising at least one power amplifier (inherently) configured to provide an amount of output power which is substantially at or near a minimum amount of output power required to maintain a selected bit rate between the RRH and the mobile unit via the wireless communication link (see 0006).
As per claim 14, Kim disclosed the PA has a maximum output power level which is substantially at or near a minimum amount of output power required to maintain the selected bit rate between the RRH and the mobile unit via the wireless communication link (see 0006).
As per claims 15 and 20, Kim disclosed the maximum output power level of the PA is determined based upon at least one or more of an actual achieved bit rate for a link in a cell of a cellular network (see abstract, 0031, 0075-0080).
As per claims 16 and 20, Kim disclosed the selected bit rate is one of an achieved bit rate or a desired bit rate (see 0006, 0031, 0075-0080).
As per claims 18-19, Kim disclosed means for receiving one or more control signals to dynamically scale an output power of the PA such that the PA is operated to provide an amount of transmitted output power substantially corresponding to an amount of transmit power needed to maintain the selected bit rate (see 0075-0080).
