Claim Rejections - 35 USC § 112
The following is a quotation of 35 U.S.C. 112(b):
(b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention.
The following is a quotation of 35 U.S.C. 112 (pre-AIA ), second paragraph:
The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention.
Claims 1-20 are rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant), regards as the invention.
Claim 1 is rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being incomplete for omitting essential structural cooperative relationships of elements, such omission amounting to a gap between the necessary structural connections. See MPEP § 2172.01. The omitted structural cooperative relationships are:
Regarding Claim 1
Claim 1 recites a device for reducing moisture and at least one sensor near the device. But there is no disclosure of the relationship between the sensor and the device. Later in dependent claims 4 and 5 further recites sensor is wireless sensor and a wireless gateway. But there is no disclosure on the relationship between the sensor and the device. The Office takes an assumption that the sensors are used to send measurement to control the operation of the device. A receiver or a controller is required to perform such performance. However, there is no disclosure. Instead, Applicant merely discloses sensors attached to a porous material.
In Reference to Claims 2-20
Claims 2-10 are rejected due to the virtue dependency to Claim 1.
Claim 11 are rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being incomplete for omitting essential steps, such omission amounting to a gap between the steps. See MPEP § 2172.01. The omitted steps are:
Regarding Claim 11
Claim 11 recites a method for reduction of moisture in porous material, the method providing a device and providing at least one sensor. The Applicant does not teach the step of transferring the measurement to the device and controlling the operation of the device. The Applicant recites two steps, the relationship between two steps has not been disclosed. The Office considers that the step of communication between the sensor or the device is critical and cannot be omitted.
Regarding Claim 12-20
Claims 12-20 are rejected due to their virtue dependency to Claim 11.
