Office Action

§112
Notice of Pre-AIA or AIA Status The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . Applicant’s amendments and remarks filed March 23, 2026 have been received and reviewed. Claims 209, 212, 214-217, 223-228, 231 and 232 are now pending in this application. Claims 209, 212, 214-217 and 223-226 are drawn to a method for inhibiting MASP-2 in a subject having a MASP-2-associated disease or disorder, the method comprising administering to the subject an effective amount of a compound of Structure (I). Claims 227, 228, 231 and 232 are drawn to a method for treating a MASP-2-associated disease or disorder in a subject in need thereof, the method comprising administering to the subject an effective amount of a compound of Structure (I-A). Terminal Disclaimer The terminal disclaimer filed on March 23, 2026 disclaiming the terminal portion of any patent granted on this application which would extend beyond the expiration date of U.S. Patent No. 12,030,853 has been reviewed and is accepted. The terminal disclaimer has been recorded. Claim Rejections - 35 USC § 112 Claims 209, 212, 214-217, 223 and 224 are rejected under 35 U.S.C. 112(a) or 35 U.S.C. 112 (pre-AIA ), first paragraph, as failing to comply with the enablement requirement. The claims contain subject matter which was not described in the specification in such a way as to enable one skilled in the art to which it pertains, or with which it is most nearly connected, to use the invention. The basis of this rejection is the same as given in the previous office action and is incorporated herein fully by reference. Applicant’s arguments have been fully considered but not found persuasive. Regarding the diseases or disorders that are somehow associated with MASP-2, there was no reference cited that teaches one skilled in the art which disease or disorder is somehow associated with MASP-2. Thus, one skilled in the art cannot say for sure who the subject is who needs their MASP-2 inhibited. Applicants have not provided any peer-reviewed journal articles or references that teaches the skilled artisan to identify the subject. The specific set of diseases that Applicants refer to, would be enabled if such correlation is known in the art. However, such correlation was not found. Claims 225-228, 231 and 232 are not rejected. Allowable Subject Matter Claims 225-228, 231 and 232 are objected to as being dependent upon a rejected base claim, but would be allowable if rewritten in independent form including all of the limitations of the base claim and any intervening claims. THIS ACTION IS MADE FINAL. Applicant is reminded of the extension of time policy as set forth in 37 CFR 1.136(a). A shortened statutory period for reply to this final action is set to expire THREE MONTHS from the mailing date of this action. In the event a first reply is filed within TWO MONTHS of the mailing date of this final action and the advisory action is not mailed until after the end of the THREE-MONTH shortened statutory period, then the shortened statutory period will expire on the date the advisory action is mailed, and any nonprovisional extension fee (37 CFR 1.17(a)) pursuant to 37 CFR 1.136(a) will be calculated from the mailing date of the advisory action. In no event, however, will the statutory period for reply expire later than SIX MONTHS from the mailing date of this final action.
