Notice of Pre-AIA or AIA Status The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . Claim Objections Claims 2-10, 12-18 are objected to because of the following informalities: independent claims 1, 11 claim “ A slatted roof…” in the preamble. Dependent claims, should use “ The slatted roof…” in the preamble to positively designate a previously claim limitation “ A slatted roof” of the independent claims 1, 11. Appropriate correction is required. Claim Rejections - 35 USC § 112 The following is a quota ation of 35 U.S.C. 112(b): (b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention. The following is a quotation of 35 U.S.C. 112 (pre-AIA ), second paragraph: The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention. Claims 3-6, 9-10 are rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant), regards as the invention. The language of “ preferably… in particular …more preferably…” renders the claims indefinite as it confuses the scope of the claims. Allowable Subject Matter Claims 1-2, 7-8, 11-18 are allowed. Claims 3-6, 9-10 would be allowable if rewritten to overcome the rejection(s) under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), 2nd paragraph, set forth in this Office action and to include all of the limitations of the base claim and any intervening claims. The following is a statement of reasons for the indication of allowable subject matter: per claims 1-2, 7-8, prior art does not show a slatted roof for a terrace canopy having first and second slats adjacent to each other, a first slat having a first bending resistance and a second slat having a second bending resistance which is smaller than the first bending resistance, and in that the first slat is provided with an additional load such that a deflection of the first slat and the second slat are substantially equal in combination with other claimed limitations. Per claims 11-18, prior art does not a slatted roof for a terrace canopy having slats extend in a longitudinal direction, each slat having a deflection and wherein there is at least one slat that has a highest deflection, characterized in that each slat except the one with the highest deflection is provided with an additional load such that the deflection of each slat is substantially equal in combination with other claimed limitations.
