DETAILED ACTION Notice of Pre-AIA or AIA Status The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . Claims 1 and 3-8 have been presented for examination. Claim Rejections - 35 USC § 112 The following is a quotation of 35 U.S.C. 112(b): (b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention. The following is a quotation of 35 U.S.C. 112 (pre-AIA ), second paragraph: The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention. Claim 8 is rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant), regards as the invention. First off, claim 8 recites a “third voltage range” without reciting a “second voltage range”. It is unclear if claim 8 requires three voltage ranges or just two. Additionally, claim 8 recites the limitation "the predetermined time" in line 14. There is insufficient antecedent basis for this limitation in the claim. Lastly, claim 8 intends to incorporate claim 6 into claim 1 without including limitations which claim 6 is dependent upon. Specifically, claim 8 recites the “third voltage” and “the predetermined time is maintained”. These limitations are derived from limitations found in claim 4. Claim 4 recites the condition for deviating from the first voltage range for which claim 6 would “return to”. The condition is premised on rapid increase of power consumption and power generation. Since claim 8 wishes to “maintain” the “return[s] to the first voltage range within the predetermined time”, one would presume that the details continue with that presented in claim 4. Since applicants specifically omitted most of the claim details with which claim 6 depend on in claim 8, it is clear that applicant wishes to claim a broader version of claim 6. Therefore, claim 8 is incomplete for omitting essential elements, such omission amounting to a gap between the elements. See MPEP § 2172.01. According to MPEP 2173.06(II), where there is a great deal of confusion and uncertainty as to the proper interpretation of the limitations of a claim, it would not be proper to reject such a claim on the basis of prior art. As stated in In reSteele, 305 F.2d 859, 134 USPQ 292 (CCPA 1962), a rejection under 35 U.S.C. 103 should not be based on considerable speculation about the meaning of terms employed in a claim or assumptions that must be made as to the scope of the claims. For examination purposes, claim 8 has not been treated on the merits. Allowable Subject Matter Claims 1-7 are allowed. Conclusion Applicant's amendment necessitated the new ground(s) of rejection presented in this Office action. Accordingly, THIS ACTION IS MADE FINAL. See MPEP § 706.07(a). Applicant is reminded of the extension of time policy as set forth in 37 CFR 1.136(a). A shortened statutory period for reply to this final action is set to expire THREE MONTHS from the mailing date of this action. In the event a first reply is filed within TWO MONTHS of the mailing date of this final action and the advisory action is not mailed until after the end of the THREE-MONTH shortened statutory period, then the shortened statutory period will expire on the date the advisory action is mailed, and any nonprovisional extension fee (37 CFR 1.17(a)) pursuant to 37 CFR 1.136(a) will be calculated from the mailing date of the advisory action. In no event, however, will the statutory period for reply expire later than SIX MONTHS from the mailing date of this final action.
