Claims 13-14 were canceled. Receipt is acknowledged of amendment / response filed on June 10, 2026 and that has been entered. Information Disclosure Statement Receipt is acknowledged of Information Disclosure Statement (IDS), filed on 03/11/2024, which has been entered in the file. Response to Election/Restriction In response to the restriction requirement Applicants have elected Group I, which now includes claims 1-12 and 15 (after rejoining Group II, claim 15) drawn to a compound of formula (I) and the elected species as set forth and found in claim 12, such as, PNG media_image2.png 206 280 media_image2.png Greyscale with traverse, is acknowledged. However, Applicant’s arguments are rendered moot in view of the present Office action. Applicants preserve their right to file a divisional on the non-elected subject matter (if any). Claim Rejections - 35 USC § 112 The following is a quotation of 35 U.S.C. 112(b): (b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention. The following is a quotation of 35 U.S.C. 112 (pre-AIA ), second paragraph: The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention. Claim 1 is rejected under 35 U.S.C. § 112 (b) or 35 U.S.C. § 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor, or for pre-AIA the applicant regards as the invention. The expressions “preferably” (claim 1, line 10, page 3, all other occurrences, if any) and “more preferably” (claim 1, line 14, page 3, all other occurrences, if any) are indefinite, because a broad range or limitation together with a narrow range or limitation that falls within the broad range or limitation (in the same claim) is considered indefinite, since the resulting claim does not clearly set forth the metes and bounds of the patent protection desired. Note the explanation given by the Board of Patent Appeals and Interferences in Ex parte Wu, 10 USPQ2d 2031, 2033 (Bd. Pat. App. & Inter. 1989), as to where broad language is followed by "such as" and then narrow language. The Board stated that this can render a claim indefinite by raising a question or doubt as to whether the feature introduced by such language is (a) merely exemplary of the remainder of the claim, and therefore not required, or (b) a required feature of the claim. Note also, for example, the decisions of Ex parte Steigewald, 131 USPQ 74 (Bd. App. 1961); Ex parte Hall, 83 USPQ 38 (Bd. App. 1948); and Ex parte Hasche, 86 USPQ 481 (Bd. App. 1949). Further, the expression “preferably” renders the claim indefinite because it is unclear whether the limitation following the phrase is part of the claimed invention. See MPEP § 2173.05 (d). The use of expression “preferably” in the middle of the claim also may lead to confusion over the intended scope of the claim. This rejection can be overcome be deleting those expressions or to amend the claim within the context and scope of the claim in order to overcome the rejection. Objections Claims 2-12 and 15 are objected to as being dependent upon a rejected base claim 1, but would be allowable if rewritten in independent form including all of the limitations of the base claim and any intervening claims.
