Applicant’s election without traverse of Group I, claims 1-3, in the reply filed on 04 August 2026 is acknowledged.
Claim Rejections - 35 USC § 102
In the event the determination of the status of the application as subject to AIA 35 U.S.C. 102 and 103 (or as subject to pre-AIA 35 U.S.C. 102 and 103) is incorrect, any correction of the statutory basis (i.e., changing from AIA to pre-AIA ) for the rejection will not be considered a new ground of rejection if the prior art relied upon, and the rationale supporting the rejection, would be the same under either status.
The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action:
A person shall be entitled to a patent unless –
(a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale, or otherwise available to the public before the effective filing date of the claimed invention.
Claims 1-3 are rejected under 35 U.S.C. 102(a)(1) as being anticipated by Arribau (US 2004/0218465):
Regarding claim 1, Arribau discloses a mixing and stirring apparatus comprising: a mixer (10 or 10') configured to prepare a gypsum slurry; and a mixer moving device (T), wherein the mixer includes: a housing (32); a rotating plate (54) arranged inside the housing; a rotary shaft (12) connected to the rotating plate; a motor (E) connected to the rotary shaft and configured to rotate the rotating plate; and a gypsum slurry extracting device (18) configured to discharge the gypsum slurry prepared in the housing, wherein the mixer moving device is configured to move at least the housing, the rotating plate, the rotary shaft, and the gypsum slurry extracting device (see [0023] and Fig. 6).
Regarding claim 2, the rotary shaft is inserted into the housing from below the housing to be connected to the rotating plate (see Fig. 1).
Regarding claim 3, the motor is arranged below the housing; and the mixer moving device is configured to also move the motor (see Fig. 6).
