Claim Rejections – 35 USC § 112
The following is a quotation of 35 U.S.C. 112(b):
(b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention.
The following is a quotation of 35 U.S.C. 112 (pre-AIA ), second paragraph:
The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention.
Claims 1-18 are rejected to because of the following informalities:
As to claim 1, the phrase, “a PWM controller that, for each set of m sets, generates pulse waves of n- phase by comparing each of the voltage command values of n-phase with a carrier wave signal oscillating at a PWM period, and turns on and off application of a DC voltage to a winding terminal of each phase by turning on and off switching devices of each phase of the inverter by each of the pulse waves of n-phase;” is unclear as to the application of dc voltage to the winding terminal (see para’s [0063]-[0064] of applicant’s specification, page 34) because an inverter 41/42 in general (fig.1) apply ac or alternating current voltage iu1-iw1/iu2-iw2 to winding terminal (i.e. convert dc voltage to ac voltage) of each phase of AC rotary machine 7 (see fig.1).
Secondly, the phrase, “wherein, for each set of m sets, the voltage command-calculator calculates basic voltage command values of n-phase; and executes a flat-top two-phase modulation that calculates an offset voltage which makes the voltage command value of a phase of a maximum voltage in the voltage command values of n-phase coincide with a maximum value of the carrier wave signal, and calculates the voltage command values of n-phase by subtracting the offset voltage from the basic voltage command values of n-phase, or a flat- bottom two-phase modulation that calculates the offset voltage which makes the voltage command value of a phase of a minimum voltage in the voltage command values of n-phase coincide with a minimum value of the carrier wave signal, and calculates the voltage command values of n-phase by subtracting the offset voltage from the basic voltage command values of n- phase” is unclear as to subtracting the offset voltage from the basic voltage command values as applicants’ fig.5 shows (see fig.5, method steps S04, S08, para’s [0043] thru [0049] of applicant’s specification, pages 23-27) teaches dc voltage [Vdc] is subtracted from maximum voltage [Vmax1] to calculate the offset votlage Voff 1 (see equation (1))
Thirdly, essential elements of inventive steps are missing from claim 1 such as the determination of phase of maximum current absolute value of first set, determination of Vmax1, Vmin1 and Vmid1, phase of the maximum current absolute value = phase of Vmax1, phase of maximum current absolute value = phase of Vmin1 (see fig.5, steps S01, S02, S03, S05, S07, para’s [0040] thru [0049] of applicant’s specification, pages 22-27 and for second set, see fig.6, steps S11-S19, para’s [0051] thru [0056], pages 28-30 of specification).
Appropriate corrections and explanation are required.
Allowable Subject-Matter
Claims 1-18 would be allowable if rewritten or amended to overcome the rejection(s) under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), 2nd paragraph, set forth in this Office action.
The following is a statement of reasons for the indication of allowable subject matter: As to claim 1, the prior art of record(s) (closest prior arts, MORI et al., Pub. No.: US 2018/0269771 A1, Suzuki US 2011/0221375 A1) fails to teach within the same PWM period, the PWM controller shifts one or both of paired the first comparison pulse wave and the second comparison pulse wave in an advance direction or a delay direction so that a rising timing of one of a potential of the winding terminal applied by the paired first comparison pulse wave and a potential of the winding terminal applied by the paired second comparison pulse wave coincides with a falling timing of the other.
