Office Action

§112
DETAILED ACTION Notice of Pre-AIA or AIA Status The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . Information Disclosure Statement The information disclosure statement (IDS) submitted on 09/30/2024. The submission is in compliance with the provisions of 37 CFR 1.97. Accordingly, the information disclosure statement is being considered by the examiner. Claim Rejections - 35 USC § 112 The following is a quotation of 35 U.S.C. 112(b): (b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention. The following is a quotation of 35 U.S.C. 112 (pre-AIA ), second paragraph: The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention. Claims 1-5 and 8-15 are rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant), regards as the invention. Claim 1 is objected to because of the following informalities: “the inner second bracket” in lines 9 and 15 of the claim should be --the second inner bracket--. Appropriate correction is required. Claim 1 is objected to because of the following informalities: “the inner first bracket” in lines 12 and 18 of the claim should be --the first inner bracket--. Appropriate correction is required. Claim 4 is objected to because of the following informalities: “the inner first and second brackets” in line 2 of the claim should be --the first and second inner brackets--. Appropriate correction is required. Claim 5 is objected to because of the following informalities: “the inner second bracket” in lines 3 and 10 of the claim should be --the second inner bracket--. Appropriate correction is required. Claim 5 is objected to because of the following informalities: “the inner first bracket” in lines 6 and 12 of the claim should be --the first inner bracket--. Appropriate correction is required. Claim 8 is objected to because of the following informalities: “A mounting method roll damper assembly” in line 1 of the claim should be --A mounting method of the roll damper assembly--. Appropriate correction is required. Claim 13 is objected to because of the following informalities: “the inner second bracket” in lines 11 and 17 of the claim should be --the second inner bracket--. Appropriate correction is required. Claim 13 is objected to because of the following informalities: “the inner first bracket” in lines 14 and 20 of the claim should be --the first inner bracket--. Appropriate correction is required. Claim 8 recites the limitation "the spring" in line 5 of the claim. There is insufficient antecedent basis for this limitation in the claim. Regarding claim 10, “a spring” in line 6 of the claim should be --the spring--, since the spring is already introduced in the parent claim 8. Allowable Subject Matter Claims 1 and 13 would be allowable if rewritten or amended to overcome the rejection(s) under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), 2nd paragraph, set forth in this Office action. Claims 2-5, 8-12, 14 and 15 would be allowable if rewritten to overcome the rejection(s) under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), 2nd paragraph, set forth in this Office action and to include all of the limitations of the base claim and any intervening claims.
