Response to Amendment
The Amendment filed July 20th, 2026 has been entered. Claims 1-13 are pending. Claims 1, 3-6 and 11 have been amended and claims 12-13 have been added by the Applicant. Applicants’ amendments have overcome claim objections.
Claim Rejections - 35 USC § 102
The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action:
A person shall be entitled to a patent unless –
(a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale, or otherwise available to the public before the effective filing date of the claimed invention.
Claim 11 is rejected under 35 U.S.C. 102 (a)(1) as being anticipated by Thomas et al, US 5120918 [Thomas].
Regarding claim 11, Thomas discloses a vacuum switch (10) having a vacuum chamber within which two contact elements (14) are arranged, where at least one of the contact elements is a contact element having a contact body (16) consisting of a first conductive material or a composite material which comprises a first conductive material, and a contact disk (18) consisting of a composite material which, in addition to the first conductive material, comprises at least one second conductive material [col.2, lines 29-34].
Allowable Subject Matter
Claims 1-10 and 12-13 are allowed.
Independent claim 1 remains allowed as indicated in the previous Office Action.
Any comments considered necessary by applicant must be submitted no later than the payment of the issue fee and, to avoid processing delays, should preferably accompany the issue fee. Such submissions should be clearly labeled “Comments on Statement of Reasons for Allowance.”
Response to Arguments
Applicants’ amendments and arguments filed July 20th, 2026 have been fully considered. All relevant arguments have been fully addressed in the new rejections above.
Conclusion
Applicants’ amendment necessitated the new grounds of rejection presented in this Office action. Accordingly, THIS ACTION IS MADE FINAL. See MPEP § 706.07(a). Applicants are reminded of the extension of time policy as set forth in 37 CFR 1.136(a).
A shortened statutory period for reply to this final action is set to expire THREE MONTHS from the mailing date of this action. In the event a first reply is filed within TWO MONTHS of the mailing date of this final action and the advisory action is not mailed until after the end of the THREE-MONTH shortened statutory period, then the shortened statutory period will expire on the date the advisory action is mailed, and any nonprovisional extension fee (37 CFR 1.17(a)) pursuant to 37 CFR 1.136(a) will be calculated from the mailing date of the advisory action. In no event, however, will the statutory period for reply expire later than SIX MONTHS from the mailing date of this final action.
