Status of the Claims
A preliminary amendment to the claims has not been filed. Thus claims 1-13 filed on 03/18/2024 are currently pending and under examination.
Claim Rejections - 35 USC § 101
35 U.S.C. 101 reads as follows:
Whoever invents or discovers any new and useful process, machine, manufacture, or composition of matter, or any new and useful improvement thereof, may obtain a patent therefor, subject to the conditions and requirements of this title.
Claims 1-4 are rejected under 35 U.S.C. 101 because the claimed invention is directed to non-statutory subject matter. The claim(s) does/do not fall within at least one of the four categories of patent eligible subject matter because the recitation of a use claim results in an improper definition of a process, i.e. results in a claim which is not a proper process claim under 35 U.S.C. 101. (see MPEP § 2173.05(q)).
Allowable Subject Matter
Claims 5-13 are allowed. The closest prior art references are Patent application publication numbers US2015/0094470A1 (US’470) and US2020/0399291A1 (US’291).
US’470 teaches in Example 1 ([0058]-[0059]) a method for the synthesis of diisopropylaminodisilane (DIPADS) by the reaction of diisopropylamine, silane and ruthenium catalyst.
US’291 teaches in Examples 1-8 a method for the synthesis of diisopropylaminodisilane by the reaction of diisopropylamine, silane and a catalyst comprising magnesium is a bis(dihydrocarbylamino)magnesium represented by formula (R5 2N)2Mg, wherein each R5 independently is a hydrocarbyl group having from 1 to 20 carbon atoms.
However, none of the above references teach or suggest conducting the reaction in the presence of a chlorine-free catalyst comprising calcium bis(hexamethyldisilazide) and/or strontium bis(hexamethyldisilazide). Furthermore, a skilled artisan would not have been motivated in modifying the teachings of US’470 and US’291 to reasonably arrive at the instantly claimed method for the preparation of diisopropylaminosilane.
Conclusion
Claims 1-4 are rejected and claims 5-13 are allowed.
