1. The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA .
Claim Rejections - 35 USC § 112
2. The following is a quotation of 35 U.S.C. 112(b):
(b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention.
The following is a quotation of 35 U.S.C. 112 (pre-AIA ), second paragraph:
The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention.
3. Claims 6 and 9 are rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant), regards as the invention.
Firstly, with respect to claim 6, it is unclear exactly what limitation is to be conveyed by the use of “pure”; it is unclear if the language is only to convey that the epichlorohydrin is being used without solvent being present.
Secondly, with respect to claim 9, within line 1, the use of the language, “reaction 8”, is incorrect. Furthermore, it is unclear in what context the oligomer has been isolated.
Allowable Subject Matter
4. Claims 1-5, 7, and 8 are allowed.
5, Claims 6 and 9 would be allowable if rewritten or amended to overcome the rejection(s) under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), 2nd paragraph, set forth in this Office action.
6. The claims are deemed to be allowable over the prior art of record, because the prior art of record fails to disclose the claimed process steps in view of the guidance provided within page 5, lines 20-29 of the specification.
