Claim Rejections - 35 USC § 112
The following is a quotation of 35 U.S.C. 112(b):
(b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention.
The following is a quotation of 35 U.S.C. 112 (pre-AIA ), second paragraph:
The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention.
Claims 1, 3-13, 15 and 17-22 are rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant), regards as the invention.
Regarding claims 1, 12, 17 (and by dependency all claims)
The claim limitation “marking and/or lettering” is indefinite as it contains a broad limitation “marking” followed by a narrower limitation “lettering” when the and condition is taken. That is, what would be lettering that isn’t also marking?
The claims contain “at least one beam source” later followed by just “the beam source” leaving the claim indefinite as to whether there may still be plural beam sources.
The claims contain “graphic and/or text” which is in conflict with the prior limitation of “cutting, engraving, marking and/or lettering”. That is may the claim now only include a “cutting” which would generally not include “graphic and/or text”.
Allowable Subject Matter
Claims 1, 3-13, 15 and 17-22 would be allowable if rewritten or amended to overcome the rejection(s) under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), 2nd paragraph, set forth in this Office action.
The Examiner has reviewed the foreign search reports as well as performed a separate prior art search. US 2025/0108462 is cited for teaching a camera in the lid. However, there specific control and calibration steps as required in the current claims are not present.
