Office Action

§102
Notice of Pre-AIA or AIA Status The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . Claim Interpretation With respect to claims 4 and 17, the “when the PBPS mode is determined to be used…” and “when the CPS mode is determined to be used…” are considered conditional clauses based on result of the “determining” steps, rather than optional clauses. Claim Rejections - 35 USC § 102 The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action: A person shall be entitled to a patent unless – (a)(2) the claimed invention was described in a patent issued under section 151, or in an application for patent published or deemed published under section 122(b), in which the patent or application, as the case may be, names another inventor and was effectively filed before the effective filing date of the claimed invention. Claim(s) 1-3 and 14-16 is/are rejected under 35 U.S.C. 102(a)(2) as being anticipated by Farag (US 2022/0312479 A1 with effective filing date of 07/28/2021 based on Provisionals 63/226542, 63/168839 and 63/162891) . Farag teaches re-evaluation and pre-emption checking (paragraphs 0089-0093) wherein the resource re-evaluation check in controlled to not overlap with partial sensing windows (Figure 9 and paragraphs 0153-0154) and when there is overlap the resource re-evaluation check is performed through a portion of the partial sensing window (Figure 10 and paragraphs 0184-0185). With respect to the claims, references to the prior art appear in parenthesis. Claims 1. (Original) A resource reservation method (Farag, US 2022/0312479 A1) , the method comprising: when a resource reservation mode of a current service comprises partial sensing and re-evaluation and/or preemption checking, controlling the partial sensing not to overlap with the re-evaluation and/or the preemption checking in a time domain (Figure 9 and paragraphs 0153-0154 where the re-evaluation or pre-emption check in resource slot C does not overlap with the partial Sensing Windows) ; or, when there is an overlapping portion between the partial sensing and the re-evaluation and/or the preemption checking in the time domain, performing the re-evaluation and/or the preemption checking through the partial sensing for the overlapping portion (Figure 10 and paragraphs 0184-0185 where the re-evaluation or pre-emption check in resource slot C0 overlaps within the second partial Sensing Window) ; and reserving a target resource for information transmission based on a sensing result of the re-evaluation and/or the preemption checking (Pre-selected resource is signaled for SL transmission or a new sidelink resource is re-selected based on the results of the re-evaluation check (paragraph 0090) and pre-emption check (paragraph 0092)) . 2. (Original) The method according to claim 1, wherein the controlling the partial sensing not to overlap with the re-evaluation and/or the preemption checking in the time domain, comprises: determining an end time of the partial sensing (Slot B2 corresponds to the end time of the second partial sensing window in paragraph 0154) ; and performing the re-evaluation and/or the preemption checking after the end time of the partial sensing (Resource re-evaluation check in slot C is performed after the end time of the second partial sensing window in paragraph 0154) . 3. (Original) The method according to claim 2, wherein the performing the re- evaluation and/or the preemption checking after the end time of the partial sensing, comprises: performing the re-evaluation and/or the preemption checking through continuous sensing after the end time of the partial sensing (Re-evaluation or pre-emption is performed in the second contiguous partial sensing window (i.e. continuous sensing) after the end time of the first contiguous partial sensing window in paragraph 0154) . 14. (Original) A terminal device (Farag, US 2022/0312479 A1) , comprising: a memory, a transceiver, and a processor; wherein the memory is configured to store computer instructions; the transceiver is configured to send and receive data under control of the processor; the processor is configured to read a computer program in the memory and execute following steps: when a resource reservation mode of a current service comprises partial sensing and re-evaluation and/or preemption checking, controlling the partial sensing not to overlap with the re-evaluation and/or the preemption checking in a time domain (Figure 9 and paragraphs 0153-0154 where the re-evaluation or pre-emption check in resource slot C does not overlap with the partial Sensing Windows); or, when there is an overlapping portion between the partial sensing and the re-evaluation and/or the preemption checking in the time domain, performing the re-evaluation and/or the preemption checking through the partial sensing for the overlapping portion (Figure 10 and paragraphs 0184-0185 where the re-evaluation or pre-emption check in resource slot C0 overlaps within the second partial Sensing Window); and reserving a target resource for information transmission based on a sensing result of the re-evaluation and/or the preemption checking (Pre-selected resource is signaled for SL transmission or a new sidelink resource is re-selected based on the results of the re-evaluation check (paragraph 0090) and pre-emption check (paragraph 0092)). 15. (Original) The terminal device according to claim 14, wherein the processor is further configured to: determine an end time of the partial sensing (Slot B2 corresponds to the end time of the second partial sensing window in paragraph 0154); and perform the re-evaluation and/or the preemption checking after the end time of the partial sensing (Resource re-evaluation check in slot C is performed after the end time of the second partial sensing window in paragraph 0154) . 16. (Original) The terminal device according to claim 15, wherein the processor is further configured to: perform the re-evaluation and/or the preemption checking through continuous sensing after the end time of the partial sensing (Re-evaluation or pre-emption is performed in the second contiguous partial sensing window (i.e. continuous sensing) after the end time of the first contiguous partial sensing window in paragraph 0154) . Allowable Subject Matter Claims 4-9, 11, 17-22 and 24 are objected to as being dependent upon a rejected base claim, but would be allowable if rewritten in independent form including all of the limitations of the base claim and any intervening claims. The following is a statement of reasons for the indication of allowable subject matter: the prior art of record do not anticipate or make obvious the additional feature of determining whether to use PBPS mode or CPS mode to perform the re-evaluation or pre-emption checking through the partial sensing.
