CTNF 18/696,948 CTNF 81570 DETAILED ACTION Notice of AIA Status The instant application, filed on or after 16 March 2013, is being examined under the first inventor to file provisions of the Leahy-Smith America Invents Act (AIA). If the status of the application as subject to AIA or pre-AIA is incorrect, any correction of the statutory basis (e.g., changing from AIA to pre-AIA) for a rejection under 35 U.S.C. §§ 102 and/or 103 will not be considered a new ground of rejection if the prior art relied upon, and the rationale supporting the rejection, would be the same under either status. Status of the Claims The listing of claims filed 25 October 2024 has been examined. Claims 1–3, 6, 13, 15, 19–24, 26–28, 33, 34, 52–59, 67, and 70–73 are pending. Claims 4, 5, 7–12, 14, 16–18, 25, 29–32, 35–51, 60–66, 68, 69, and 74 are canceled. Claims 3, 6, 13, 15, 19, 21, 23, 24, 26–28, 33, 52, 5, 55–57, 59, 67, and 70 are amended. Benefit of Earlier Filing Date The instant application was filed 28 March 2024; is a national stage application of PCT/US2022/26624, filed 28 April 2022, and claims the benefit of an earlier filing date of U.S. Prov. Pat. App. Serial No. 63/181,627, filed 29 April 2021. Applicant’s claim is acknowledged. Information Disclosure Statement The information disclosure statements (IDS) submitted on 4 April 2025; 12 September 2025; and 3 October 2025 are acknowledged and have been considered. Objections to the Specification The abstract of the disclosure is objected to because it recites phrases that can be implied (“The present disclosure provides”) and legal phraseology (“comprising”). Appropriate correction is required. Examiner recommends starting the Abstract with “Compounds useful . . .” and replacing “comprising” with “including” or “having.” For guidelines for the preparation of patent abstracts, see MPEP § 608.01(b) ( Explaining : The abstract should be in narrative form and avoid legal phraseology (e.g., means , said ), terms referring to purported merits of the invention (e.g., new , novel ), and phrases that can be implied (e.g., The disclosure concerns , The disclosure defined by this invention ). The language should be clear and concise, and not repeat information given in the title. It should not compare the invention with the prior art. The abstract is generally limited to a single paragraph within the range of 50 to 150 words in length.). Claim Objections Claim 1 is objected to because of the following informalities. Claim 1 recites “R 3 hydrogen, halogen . . .” The word “is” should be inserted between “R 3 ” and “hydrogen” for the purpose of improving clarity. Appropriate correction is required. Claim Rejections - 35 U.S.C. § 112 The following is a quotation of 35 U.S.C. § 112(b): (b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention. Claims 19–22 and 55 are rejected under 35 U.S.C. § 112(b) as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor regards as the invention. Claims 19–22 recite, “the other two R x .” Claims 19–22 depend directly or indirectly from claim 1. Claim 1 does not require multiple R x substituents (m = 0–4) and claim 1 does not recite “other two R x .” As such, there is insufficient antecedent basis for using definite article “the” in “the other two R x ” because there is no requirement of three R x groups (m=3) and no preceding recitation of indefinite article “a” or “an” “other two R x ” in the claim of the claim(s) from which it depends. Appropriate correction is required. (ii) Claim 55 recites, “wherein R 4 is halogen (e.g., fluorine).” A broad limitation together with a narrow limitation that falls within the broad limitation (in the same claim) may be considered indefinite if the resulting claim does not clearly set forth the metes and bounds of the patent protection desired. See MPEP § 2173.05(c). Claim 55 is considered indefinite because there is a question or doubt as to whether the feature introduced by such narrower language is (a) merely exemplary of the remainder of the claim, and therefore not required, or (b) a required feature of the claims. Appropriate correction is required. Claim Rejections - 35 U.S.C. § 102 07-07-aia AIA 07-07 The following is a quotation of the appropriate paragraphs of 35 U.S.C. § 102 that form the basis for the rejections under this section made in this Office action: A person shall be entitled to a patent unless – 07-08-aia AIA (a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale, or otherwise available to the public before the effective filing date of the claimed invention. 07-12-aia AIA (a)(2) the claimed invention was described in a patent issued under section 151, or in an application for patent published or deemed published under section 122(b), in which the patent or application, as the case may be, names another inventor and was effectively filed before the effective filing date of the claimed invention. 07-15 AIA Claim s 1–3, 6, 13, 15, 19–24, 26–28, 33, 34, 52–59, 67, and 70–73 are rejected under 35 U.S.C. §§ 102( a)(1) and (a)(2 ) as being anticipated by WO2021/218110 (“Wan”), filed 10 November 2020; published 11 April 2021 [IDS] . US2023/0174526 (“Wan-US”) is an English translation of Wan and is referenced below. Wan discloses the following compounds: PNG media_image1.png 290 1247 media_image1.png Greyscale (Wan, p.17). The compounds read on instant formula (I) when: m = 0 or 1 (R x = alkyl); Z = CR’ (R’ = cyano); W = N; R 2 and R 4 = halogen; L = -O-alkylene; R 1 = heterocycloalkyl; R 3 = halogen; R q = hydrogen; n = 1 [if there are any errors in this description, the structures above control]. Claims 15 and 19–21 do not require m = 2 or 3. Claims 26 and 27 do not require R b or R z . Claims 33 and 34 do not require R 5 or R w . The dependent claims defining a variable that is not required are anticipated because they depend from a claim that is otherwise anticipated. In other words, if such limitations were added to the base claim, the base claim would still be anticipated. Wan discloses pharmaceutical compositions of the disclosed compounds. ( Id ., Abstract; Wan-US, ¶195) Wan discloses a method of treating pancreatic cancer, etc. via the inhibition of KRAS G12C . (Wan-US, ¶¶4; 199; 203; 268; 382–400). Conclusion No claims are allowed.
