DETAILED ACTION
The Amendment filed 07/27/26 has been entered. Claims 1 and 3-4 are currently pending, with claim 2 being cancelled and claims 3-4 being newly added. In light of the claim amendments, the previous rejection is withdrawn. However, a revised 102 rejection of all pending claims is detailed below. The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA .
Claim Rejections - 35 USC § 102
The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action:
A person shall be entitled to a patent unless –
(a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale, or otherwise available to the public before the effective filing date of the claimed invention.
Matsuda
Claim(s) 1 and 3-4 is/are rejected under 35 U.S.C. 102(a)(1) as being anticipated by Matsuda (U.S. Patent Pub. No. 2018/0339699). Matsuda is directed to a motorcycle vehicle controller. See Abstract.
Claim 1: Matsuda discloses a control device [Figs. 1, 3] for a motorcycle (1), comprising: an inclination angle detector (13) that detects an inclination angle of the motorcycle; a throttle grip opening detector (14); a throttle valve controller (35) that controls a throttle valve (24) [see para. 0057]; a brake controller (8) that controls a front wheel brake (6) and a rear wheel brake (7); and a controller (10) that controls the throttle valve controller and the brake controller, wherein the controller controls at least the throttle valve, the front wheel brake, and the rear wheel brake during turning of the motorcycle [see Fig. 3] and wherein, when a throttle grip opening detected by the throttle grip opening detector reaches a certain value or less, fluid pressures of the front wheel brake and the rear wheel brake are maintained at a higher state than a controlled amount of fluid pressure corresponding to an operation of the front wheel brake and the rear wheel brake by a rider [see para. 0038-46, 0067]. See Figs. 1, 3.
Claim 3: Matsuda discloses that the controller starts decreasing the fluid pressures of the front wheel brake and the rear wheel brake when a roll angle reaches a certain value or more. See para. 0064, 0067 (both front and rear).
Claim 4: Matsuda discloses that the controller is configured such that control intervention of the fluid pressures of the front wheel brake and the rear wheel brake continues when a throttle grip has been opened to transition to an acceleration state. See para. 0056-58.
Response to Arguments
Applicant’s arguments with respect to claim(s) 1 and 3-4 have been considered but are moot because the new ground of rejection does not rely on any reference applied in the prior rejection of record for any teaching or matter specifically challenged in the argument.
Conclusion
Applicant's amendment necessitated the new ground(s) of rejection presented in this Office action. Accordingly, THIS ACTION IS MADE FINAL. See MPEP § 706.07(a). Applicant is reminded of the extension of time policy as set forth in 37 CFR 1.136(a).
A shortened statutory period for reply to this final action is set to expire THREE MONTHS from the mailing date of this action. In the event a first reply is filed within TWO MONTHS of the mailing date of this final action and the advisory action is not mailed until after the end of the THREE-MONTH shortened statutory period, then the shortened statutory period will expire on the date the advisory action is mailed, and any nonprovisional extension fee (37 CFR 1.17(a)) pursuant to 37 CFR 1.136(a) will be calculated from the mailing date of the advisory action. In no event, however, will the statutory period for reply expire later than SIX MONTHS from the mailing date of this final action.
