DETAILED ACTION Notice of Pre-AIA or AIA Status The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . Drawings New corrected drawings in compliance with 37 CFR 1.121(d) are required in this application because Fig. 3 was repeated twice in the submitted drawings on April 5, 20024. In the “Documents submitted with 371 (National Stage) Applications” filed on April 5, 2024, from which the drawings are scanned into the application, there are two Fig. 3 drawings listed and no Fig. 2 listed. The applicant must submit the correct Fig. 2 drawing as provided in the Certified Copy of Foreign Priority Application filed on April 5, 2004 and shown below. The corrected drawing is required in reply to the Office action to avoid abandonment of the application. The requirement for corrected drawings will not be held in abeyance. The following is a quotation of 35 U.S.C. 112 (pre-AIA ), second paragraph: The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention. Claims 1-11 rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant), regards as the invention. In claim 1, line 17, the phrase “the first suction orifices” lacks antecedent basis. The phrase should be changed to --first suction orifices-- to provide proper antecedent basis and to clearly define the invention. In claim 1, line 19, the phrase “the regulator” lacks antecedent basis. The phrase should be changed to --a regulator-- to provide proper antecedent basis and to clearly define the invention. In claim 1, line 22, the phrase “the second suction orifices” lacks antecedent basis. The phrase should be changed to --second suction orifices-- to provide proper antecedent basis and to clearly define the invention. In claim 1, line 24, the phrase “the outlet partition” lacks antecedent basis. The phrase should be changed to --an outlet partition-- to provide proper antecedent basis and to clearly define the invention. In claim 1, line 29, the phrase “the outlet channel” lacks antecedent basis. The phrase should be changed to --an outlet channel-- to provide proper antecedent basis and to clearly define the invention. In claim 1, line 32, the phrase “an outlet partition” raises double inclusion issues since such a limitation has already been introduced in line 24. The phrase should be changed to --the outlet partition--. Allowable Subject Matter Claims 1-11 would be allowable if rewritten or amended to overcome the rejection(s) under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), 2nd paragraph, set forth in this Office action. The following is a statement of reasons for the indication of allowable subject matter: The closest prior art being Grindley ‘688, Scott et al ‘226 and Kaylor ‘105 did not teach or suggest separately or in combination handheld fire extinguishing equipment as claimed by the applicant, specifically handheld fire extinguishing equipment wherein the firefighting nozzle includes first suction orifices, which are aligned along the perimeter of the mixing chamber for the supply of regulatable outside atmospheric air into the mixing chamber, are through a regulator of intake outside air connected with the air chamber, connected to the mixing chamber, second suction orifices, for the supply regulatable outside atmospheric air into an outlet adapter, are situated along the perimeter of the adapter immediately behind the outlet partition of outlet chamber, the mixing chamber, which is on one end connected to a narrower end of the conical water inlet nozzle, connected through the water chamber to the inlet of water, and on the opposite end, the mixing chamber is connected to an outlet channel linked to the outlet chamber, the outlet chamber, fitted perpendicularly to the direction of longitudinal axis of the firefighting nozzle, with the outlet partition fitted with outlet orifice, together in combination with the other claimed features of applicant’s invention and if the 35 U.S.C. 112(b) rejections are corrected. Conclusion The prior art made of record and not relied upon is considered pertinent to applicant's disclosure. Grindley ‘688, Scott et al ‘226, Kaylor ‘105 and Carroll et al ‘809 disclose various firefighting nozzles with air suction.
