Claim Rejections - 35 USC § 102
The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action:
A person shall be entitled to a patent unless –
(a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale, or otherwise available to the public before the effective filing date of the claimed invention.
Claims 1, 3 and 5-7 are rejected under 35 U.S.C. 102(a)(1) as being anticipated by Haddock (EP0130080), cited in IDS.
Haddock discloses an aqueous emulsion for forming a pressure-sensitive adhesive composition, comprising a copolymer of 95% wt. of butyl acrylate and 5% wt. of vinyl caprolactam (see Example 1 at 0026).
In reference to claim 3, since amount of ureido containing monomer includes zero percent, the component is optional.
Regarding claims 5 and 6, Haddock teaches an emulsion polymerization of the monomers above, coating the resulting latex onto a substrate and drying it to remove water (se Example 1 and 0019-0020).
In reference to claim 7, Haddock teaches a surgical pressure sensitive adhesive based on the latex above and its application to human skin (see 0001 and 0031).
Claims 1-7 are rejected under 35 U.S.C. 102(a)(1) as being anticipated by Naoki et al (JP2014221914), cited in IDS.
Naoki teaches a composition obtained by emulsion polymerization , which contains 91% of acrylate esters (i.e., 45.5 % wt. of butyl acrylate (BA) and 45.5 % wt. of 2-ethylhexyl acrylate, 5% wt. of methylmethacrylate (MMA) and 1.5% wt. of N-vinyl pyrrolidone (see Table 1, Example 1 at page 31) .
Regarding claim 4, Naoki teaches a tackifier (see claim 1).
Regarding claims 6 and 7, Naoki teaches a laminating process with includes coating the adhesive above on a polyester film, a water removal with following contact with non-woven fabric substrate (see chapter Evaluation method (adhesive tape)).
