Election/Restrictions
The restriction/election requirement dated 25 March 2026 is withdrawn in its entirety.
Claim Rejections - 35 USC § 112
The following is a quotation of 35 U.S.C. 112(b):
(b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention.
The following is a quotation of 35 U.S.C. 112 (pre-AIA ), second paragraph:
The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention.
Claims 57 – 73 are rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant), regards as the invention.
Regarding Claims 57 and 73, the claim appears to intend to set forth a “method of quality testing an airflow path” but there do not appear to be any steps that result in a quality determination, thus rendering the claim indefinite. Furthermore, it is unclear as to how quality is measured/determined, thus rendering the claim indefinite.
Regarding Claim 63, the claim recites “a predetermined stabilization time”. It is unclear as to what is being stabilized and what the stabilization criteria are, thus rendering the claim indefinite.
Regarding Claim 70, the claim recites “the heater assembly”. It is unclear as to what heater assembly the claim refers to as Claim 57 appears to recite an aerosol-generating device or a heater assembly, thus rendering the claim indefinite.
Claims dependent upon a rejected claim are therefore rejected as well.
Allowable Subject Matter
Claims 57 - 73 would be allowable if rewritten or amended to overcome the rejection(s) under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), 2nd paragraph, set forth in this Office action.
