Notice of Pre-AIA or AIA Status The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . Response to Arguments Applicant’s arguments with respect to claim(s) are rejected under 103 have been considered but are moot because the new ground of rejection does not rely on any reference applied in the prior rejection of record for any teaching or matter specifically challenged in the argument. Applicant argued in the remark that as per claim 2, the Applicant respectfully submits that claim 2 defines that the auxiliary information includes the indication information of the system information that is capable to be obtained/forwarded, thus claim 2 aims to define which system information is capable to be obtained/forwarded, regardless of whether the system information is obtained/forwarded. Examiner respectfully disagrees. Examiner is considering the limitation claim by claim. All the independent claims recite the phase “indicate a capability of the first device..” this indication might not be happened then the UE is not operable. Thus, boundary of the UE is indefinite. Moreover, those claim recites the phase “ transmitting a request for obtaining system information… , is the second UE transmitting a request after the request message? or there is a third UE is transmitting a new request for the system information to the second UE. Thus, boundary of the limitation is not clear. Therefore, examiner is maintaining the 112 rejections. Applicant argued in the remark that the capability information indicates the capability to obtain the system information, Examiner respectfully disagrees. Hong et al US 2020/0008132 discloses transferring auxiliary information to a second UE, wherein the auxiliary information is configured to indicate a capability of the first UE to obtain system information provided by a network device ([0007] determining an information type of system information to be transmitted, wherein the information type is configured to indicate a network device that triggers the system information; wherein the network device is providing the system information for the UE and [0012] a transmitter configured to transmit the system information to UE within the coverage of a base station by broadcasting when the system information is first system information, wherein the first system information is triggered by the base station, 0017 wherein the information type is configured to indicate a network device that triggers the system information; transmit the system information to User Equipment (UE) within the coverage of the base station by broadcasting when the system information is first system information, wherein the first system information is triggered by the base station; and transmit the system information to the UE by unicasting or broadcasting when the system information is second system information, wherein the second system information is triggered by the UE ); receiving a system information request message from the second UE ( [0035] A quantity of first information and a quantity of the second information are determined when transmission requests for transmitting specific system information are received from a plurality of UE, the plurality of UE, i.e. the second UE) ; Claim Rejections - 35 USC § 112 The following is a quotation of 35 U.S.C. 112(b): (b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention. The following is a quotation of 35 U.S.C. 112 (pre-AIA ), second paragraph: The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention. Claims 1-11 and 14-22 are rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant), regards as the invention. As per claims 1/8/14/15/16/17, those claims recite the phase “indicate a capability of the first device..” this indication might not be happened because of the phase capability, then the UE is not operable. Thus, boundary of the UE is indefinite. Moreover, those claim recites the phase “ transmitting a request for obtaining system information… , is the second UE transmitting a request after the request message? or there is a third UE is transmitting a new request for the system information to the second UE. Thus, boundary of the limitation is not clear. All the dependents’ claims are rejected based on the same rationale set forth in the above claims respectively. Claim Rejections - 35 USC § 103 The following is a quotation of 35 U.S.C. 103 which forms the basis for all obviousness rejections set forth in this Office action: A patent for a claimed invention may not be obtained, notwithstanding that the claimed invention is not identically disclosed as set forth in section 102, if the differences between the claimed invention and the prior art are such that the claimed invention as a whole would have been obvious before the effective filing date of the claimed invention to a person having ordinary skill in the art to which the claimed invention pertains. Patentability shall not be negated by the manner in which the invention was made. Claim(s) 1-3,6-8,11,14-17,19 and 22 are is/are rejected under 35 U.S.C. 103 as being unpatentable over Ren et al US2019/0261349 in view of Hong et al US 2020/0008132 in view of SHI et al US 2020/0252853(Shi 1). As per claim 1. Ren discloses a method for transmitting auxiliary information, performed by a first user equipment (UE), comprising: transferring auxiliary information to a second UE (fig.3, first device sends M signals to a second device through N ports), wherein the auxiliary information is configured to indicate a capability of the first UE to obtain system information (fig.3, the second device measures the M signals to obtain measurement information and The second device sends the measurement information to the first device). Ren does not explicitly disclose obtain system information provided by a network device; receiving a system information request message from the second UE; and transmitting a request for obtaining system information corresponding to the system information request message to the network device. Therefore, it would have been obvious to someone of ordinary skill in the art before the effective filing date of the claimed invention to have modified Ren to incorporate the teachings of Hong and provide a network device to trigger the system information. Doing so would provide enhanced efficiency of the mobile device, thereby would improve to safety and cost saving of the service.
