Information Disclosure Statement 06-49 AIA The information disclosure statement filed 24 April 2024 fails to comply with the provisions of 37 CFR 1.97, 1.98 and MPEP § 609 because the signature area for the Examiner's signature is improperly formatted and cannot be utilized . Claim Rejections - 35 USC § 102 07-06 AIA 15-10-15 In the event the determination of the status of the application as subject to AIA 35 U.S.C. 102 and 103 (or as subject to pre-AIA 35 U.S.C. 102 and 103) is incorrect, any correction of the statutory basis (i.e., changing from AIA to pre-AIA) for the rejection will not be considered a new ground of rejection if the prior art relied upon, and the rationale supporting the rejection, would be the same under either status. 07-07-aia AIA 07-07 The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action: A person shall be entitled to a patent unless – 07-12-aia AIA (a)(2) the claimed invention was described in a patent issued under section 151, or in an application for patent published or deemed published under section 122(b), in which the patent or application, as the case may be, names another inventor and was effectively filed before the effective filing date of the claimed invention. 07-15-03-aia AIA Claim(s) 1 - 4, 6, 8 11, 15, 17 - 20, 22, 24, 27, 31, 65, and 66 is/are rejected under 35 U.S.C. 102(a)(2) as being rejected by Babaei, U.S. Patent Publication No. 2024/0064491 . Babaei teaches: 1. (Original) A random access method, performed by a terminal, comprising: determining at least one set of random access resources; and sending a random access preamble to a network device based on the at least one set of random access resources (the random access process may comprise transmitting a random access preamble via a random access resource, [0147]) . 2. (Original) The method according to claim 1, wherein the random access resource comprises at least one of: a time domain resource; a frequency domain resource; a random access preamble (random access preamble, [0147]) ; or a quasi co-location parameter. 3. (Currently Amended) The method according to claim 2, wherein at least two sets of random access resources comprise at least one of: frequency domain resources; and the frequency domain resources comprised in any two sets of random access resources of the at least two sets of random access resources are being different, time domain resources; and the time domain resources comprised in any two sets of random access resources of the at least two sets of random access resources being different, random access preambles; and the random access preambles comprised in any two sets of random access resources of the at least two sets of random access resources being different, or quasi co-location parameters (UE may be configured with different sets of random access resources and the beams may be associated with different random access preambles, [0147]) ; and the quasi co-location parameters of any two sets of random access resources of the at least two sets of random access resources being different. 4. (Original) The method according to claim 3, wherein the frequency domain resources of the at least two sets of random access resources are continuous, or the frequency domain resources of the at least two sets of random access resources are discontinuous (this claim is simply a tautology, any set of frequency resources are either continuous or not continuous) . 6. (Currently Amended) The method according to claim 3, wherein the quasi co-location parameters of the at least two sets of random access resources correspond to different SSBs (random access resource may indicate QCL reference signals (CSI-RSs or SSBs) associated with multiple beams, [0149]) , or the quasi co-location parameters of the at least two sets of random access resources are at least one of quasi co-location parameters indicated by a radio resource control (RRC) or downlink control information (DCI), or are at least one of quasi co-location parameters used for receiving a physical downlink control channel (PDCCH) order. 15. (Currently Amended) The method according to claim 1, further comprising: determining a reception time of a random access feedback based on the at least one set of random access resources (generally, a 3GPP compliant system [0035], has a random access channel timing offset to generally compute a reception time for PRACH resources, see generally 3GPP document R1-1705458) . 17.
