DETAILED ACTION Priority and Status of Claims 1. This application is a 371 of PCT/CN2022/128426 10/28/2022, which claims benefit of the foreign applications: CHINA 202111271704.9 10/29/2021, CHINA 202210103242.8 01/27/2022, CHINA 202210899553.X 07/28/2022, and CHINA 202211063507.2 09/01/2022 2. Claims 1-2, 4-9, 11-19 and 23-25 are pending in the application. 3. In the event the determination of the status of the application as subject to AIA 35 U.S.C. 102 and 103 (or as subject to pre-AIA 35 U.S.C. 102 and 103) is incorrect, any correction of the statutory basis for the rejection will not be considered a new ground of rejection if the prior art relied upon, and the rationale supporting the rejection, would be the same under either status. Claim Rejections - 35 USC § 102 4. The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action: A person shall be entitled to a patent unless – (a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale, or otherwise available to the public before the effective filing date of the claimed invention. Claim 1 is rejected under 35 U.S.C. 102 (a) (1) as being anticipated by Yuan et al. Z. Naturforsch, 2015, 70(10)b: 727-734. Applicant claim a compound of formula (I), i.e., PNG media_image1.png 260 374 media_image1.png Greyscale , wherein ring Q is phenyl substituted with R10 and R10 is OH, heteroaryl, or heterocycle; X is PNG media_image2.png 128 300 media_image2.png Greyscale , ring B is heterocycle or heteroaryl, R4 or R5 is H or alkyl and p is 0-2; ring D is heterocycle or heteroaryl, and L is bond or -CR8R9 and R8 or R9 is H or alkyl, or X is alkyl substituted with Re and Re is -N(alkyl)2; A1-A2-A3 is C=C-A3, wherein the A3 is selected from NR12,O or S; n is selected from 0 or 1; Y1, Y2, Y3 and Y4 is selected from CRb or N and Rb is hydrogen; R1 and R2 are H, halogen, alkyl; and W is (CR13R14)kW1, R13 and R14 are H, alkyl, and W1 is heterocycle or heteroaryl, see claim 1. They clearly anticipate the instant compounds of formula (I), wherein ring Q is phenyl substituted with R10 and R10 is OH, heteroaryl, or heterocycle; X is PNG media_image2.png 128 300 media_image2.png Greyscale , ring B is heterocycle or heteroaryl, R4 or R5 is H or alkyl and p is 0-2; ring D is heterocycle or heteroaryl, and L is bond or -CR8R9 and R8 or R9 is H or alkyl, or X is alkyl substituted with Re and Re is -N(alkyl)2; A1-A2-A3 is C=C-A3, wherein the A3 is selected from NR12,O or S; n is selected from 0 or 1; Y1, Y2, Y3 and Y4 is selected from CRb or N and Rb is hydrogen; R1 and R2 are H, halogen, alkyl; and W is (CR13R14)kW1, R13 and R14 are H, alkyl, and W1 is heterocycle or heteroaryl. Claim Objections 5. Claim 2, 4-9, 11-19 and 23-25 are objected to as being dependent on rejected claim 1.
