DETAILED ACTION Notice of Pre-AIA or AIA Status The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . Election/Restrictions Applicant’s election without traverse of Group I: claims 1-6 in the reply filed on 7/31/2026 is acknowledged. Claim7 is withdrawn from further consideration pursuant to 37 CFR 1.142(b) as being drawn to a nonelected invention, there being no allowable generic or linking claim. Election was made without traverse in the reply filed on 7/31/2026. Double Patenting Claims 1-6 are provisionally rejected on the ground of nonstatutory double patenting as being unpatentable over claims 1-6 of copending Application No. 18/717,029 (reference application). Although the claims at issue are not identical, they are not patentably distinct from each other because the claims of the reference application teach an austenitic steel with a chemical composition and properties that are the same or read on that of the instant claims. This is a provisional nonstatutory double patenting rejection because the patentably indistinct claims have not in fact been patented. Claims 1-6 are provisionally rejected on the ground of nonstatutory double patenting as being unpatentable over claims 1-6 of copending Application No. 18/717,788 (reference application). Although the claims at issue are not identical, they are not patentably distinct from each other because the claims of the reference application teach an austenitic steel with a chemical composition and properties that are the same or read on that of the instant claims.
