Notice of Pre-AIA or AIA Status
The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA .
In the event the determination of the status of the application as subject to AIA 35 U.S.C. 102 and 103 (or as subject to pre-AIA 35 U.S.C. 102 and 103) is incorrect, any correction of the statutory basis for the rejection will not be considered a new ground of rejection if the prior art relied upon, and the rationale supporting the rejection, would be the same under either status.
Status of Claims
Below is the Final action on the merits for claims 1 – 12.
Priority
Receipt is acknowledged of certified copies of papers required by 37 CFR 1.55.
Claim Objections
The claim set is objected to because of the following informalities: Claim 1 in preamble should recite “A self-cleaning device” and claims 2 – 12 should recite “The self-cleaning device”. Appropriate correction is required.
Claim Rejections - 35 USC § 112
The following is a quotation of 35 U.S.C. 112(b):
(b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention.
The following is a quotation of 35 U.S.C. 112 (pre-AIA ), second paragraph:
The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention.
Claims 1 – 12 are rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant), regards as the invention.
Claim 1 recites the limitation "all the electrical components” on page 4 in lines 4 – 5. The limitation is vague in that is unclear as to what is encompassed by “all the electrical components”.
Claim 1 recites the limitation "all functions of said microcontroller” on page 4 in line 9. The limitation is vague in that is unclear as to what is encompassed by “all functions of said microcontroller”.
Claim 1 recites the limitation "the motion" on page 4 in line 7. There is insufficient antecedent basis for this limitation in the claim. For the purpose of examination, the limitation will be examined as “a motion”.
Claim 6 recites the limitation "the same" in line 4. The limitation is vague in that is unclear as to what is encompassed by “the same”.
Allowable Subject Matter
As best to be understood by Examiner, Claim 1 would be allowable if rewritten or amended to overcome the rejection(s) under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), 2nd paragraph, set forth in this Office action.
The following is an examiner’s statement of reasons for allowance: U. S. Patent No. 10,364,580 B1 to Bonachea Ruiz is disclosed as the closest prior art. Although Ruiz teaches a grout installation apparatus, the reference fails to teach, suggest or make obvious a device for applying grout to a surface wherein the device is self-cleaning using a roller which contacts the spatula that spread the material to clean it wherein the roller is rotated by a belt which engages the upper part of the roller.
Conclusion
Applicant's amendment necessitated the new ground(s) of rejection presented in this Office action. Accordingly, THIS ACTION IS MADE FINAL. See MPEP § 706.07(a). Applicant is reminded of the extension of time policy as set forth in 37 CFR 1.136(a).
A shortened statutory period for reply to this final action is set to expire THREE MONTHS from the mailing date of this action. In the event a first reply is filed within TWO MONTHS of the mailing date of this final action and the advisory action is not mailed until after the end of the THREE-MONTH shortened statutory period, then the shortened statutory period will expire on the date the advisory action is mailed, and any nonprovisional extension fee (37 CFR 1.17(a)) pursuant to 37 CFR 1.136(a) will be calculated from the mailing date of the advisory action. In no event, however, will the statutory period for reply expire later than SIX MONTHS from the mailing date of this final action.
