Information Disclosure Statement
The information disclosure statements (IDS) submitted on 05/29/2024 and 11/14/2024 are in compliance with the provisions of 37 CFR 1.97. Accordingly, the information disclosure statements are being considered by the examiner.
Drawings
The drawings are objected to because:
Fig. 6b fails to include a legend by which the figure can be understood. The specification refers to line colors in the figure, but the figure has been submitted as a black and white figure.
The written description does not appear to describe Fig. 6d.
Fig. 7a fails to include a legend by which the figure can be understood. The specification refers to line colors in the figure, but the figure has been submitted as a black and white figure.
Fig. 7b fails to include a legend by which the figure can be understood. The specification refers to line colors in the figure, but the figure has been submitted as a black and white figure.
Fig. 14 fails to include a legend by which the figure can be understood. The specification refers to line colors in the figure, but the figure has been submitted as a black and white figure.
Corrected drawing sheets in compliance with 37 CFR 1.121(d) are required in reply to the Office action to avoid abandonment of the application. Any amended replacement drawing sheet should include all of the figures appearing on the immediate prior version of the sheet, even if only one figure is being amended. The figure or figure number of an amended drawing should not be labeled as “amended.” If a drawing figure is to be canceled, the appropriate figure must be removed from the replacement sheet, and where necessary, the remaining figures must be renumbered and appropriate changes made to the brief description of the several views of the drawings for consistency. Additional replacement sheets may be necessary to show the renumbering of the remaining figures. Each drawing sheet submitted after the filing date of an application must be labeled in the top margin as either “Replacement Sheet” or “New Sheet” pursuant to 37 CFR 1.121(d). If the changes are not accepted by the examiner, the applicant will be notified and informed of any required corrective action in the next Office action. The objection to the drawings will not be held in abeyance.
Specification
The use of the terms EcoFlex and Teflon, which are trade names or marks used in commerce, has been noted in this application. The terms should be accompanied by the generic terminology; furthermore the terms should be capitalized wherever it appears or, where appropriate, include a proper symbol indicating use in commerce such as ™, SM , or ® following the term.
Although the use of trade names and marks used in commerce (i.e., trademarks, service marks, certification marks, and collective marks) are permissible in patent applications, the proprietary nature of the marks should be respected and every effort made to prevent their use in any manner which might adversely affect their validity as commercial marks.
Claim Objections
Claims 1, 7, and 17 are objected to because of the following informalities:
Claim 1: in line 7, it is recommended to change “the fluidically sealed well” to the “fluidically tight well” as explicit antecedent basis for a “fluidically sealed well” is not present.
Claim 1: in line 11, it is believed “wherein each conducting channel functionalized” should read “wherein each conducting channel is functionalized”.
Claim 7: it is believed “wherein the separating walls comprise SiO2/Si, sapphire, glass, SiC, and flexible polyimides, parylene, polyester, tape, polycarbonate, Teflon, PET, EVA/PET” should read “wherein the separating walls comprise SiO2/Si, sapphire, glass, SiC, [[and]] flexible polyimides, parylene, polyester, tape, polycarbonate, Teflon, PET, or EVA/PET”.
Claim 17: it is believed this claim should be written so as to depend on claim 16, as claim 14 does not recite n or m.
Appropriate correction is required.
Claim Rejections - 35 USC § 112

(b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention.

Claims 4, 6-7, 9-10, and 20 are rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant), regards as the invention.
Regarding claim 4, the phrase "or the like" renders the claim(s) indefinite because the claim(s) include(s) elements not actually disclosed (those encompassed by "or the like"), thereby rendering the scope of the claim(s) unascertainable. See MPEP § 2173.05(d).
Claim 6 contains the trademark/trade name EcoFlex. Where a trademark or trade name is used in a claim as a limitation to identify or describe a particular material or product, the claim does not comply with the requirements of 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph. See Ex parte Simpson, 218 USPQ 1020 (Bd. App. 1982). The claim scope is uncertain since the trademark or trade name cannot be used properly to identify any particular material or product. A trademark or trade name is used to identify a source of goods, and not the goods themselves. Thus, a trademark or trade name does not identify or describe the goods associated with the trademark or trade name. In the present case, the trademark/trade name is used to identify/describe material of the separating walls and, accordingly, the identification/description is indefinite.

TORRICELLI et al. (US Patent Application Publication 2023/0036979) is directed to a biosensor comprising an array of electrolyte-gated FETs wherein walls fluidically separate each of the FETs from one another, wherein each FET comprises graphene as a conducting material.
