Office Action

§102 §112
DETAILED ACTION Notice of Pre-AIA or AIA Status The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . Election/Restrictions Applicant’s election of Species B, M and X in the reply filed on 8/4/2026 is acknowledged. Because applicant did not distinctly and specifically point out the supposed errors in the restriction requirement, the election has been treated as an election without traverse (MPEP § 818.01(a)). In light of the search of the application, all species restrictions have been withdrawn. Once the restriction requirement is withdrawn, the provisions of 35 U.S.C. 121 are no longer applicable. See In re Ziegler, 443 F.2d 1211, 1215, 170 USPQ 129, 131-32 (CCPA 1971). See also MPEP § 804.01. Priority Receipt is acknowledged of certified copies of papers required by 37 CFR 1.55. Information Disclosure Statement The information disclosure statement submitted on 5/31/2024 has been considered by the examiner. Drawings The drawings are objected to under 37 CFR 1.83(a). The drawings must show every feature of the invention specified in the claims. Therefore, the second time interval and second time subinterval of claim 20 must be shown or the features canceled from the claim. If Applicant believes that these features are already in the drawings, the features must be provided with reference numbers and corresponding descriptions in the specification. No new matter should be entered. Corrected drawing sheets in compliance with 37 CFR 1.121(d) are required in reply to the Office action to avoid abandonment of the application. Any amended replacement drawing sheet should include all of the figures appearing on the immediate prior version of the sheet, even if only one figure is being amended. The figure or figure number of an amended drawing should not be labeled as “amended.” If a drawing figure is to be canceled, the appropriate figure must be removed from the replacement sheet, and where necessary, the remaining figures must be renumbered and appropriate changes made to the brief description of the several views of the drawings for consistency. Additional replacement sheets may be necessary to show the renumbering of the remaining figures. Each drawing sheet submitted after the filing date of an application must be labeled in the top margin as either “Replacement Sheet” or “New Sheet” pursuant to 37 CFR 1.121(d). If the changes are not accepted by the examiner, the applicant will be notified and informed of any required corrective action in the next Office action. The objection to the drawings will not be held in abeyance. Claim Objections Claim 22 is objected to because of the following informalities: Claim 22 recites the limitation "the determination of the control set point value" in lines 7-8. There is insufficient antecedent basis for this limitation in the claim; i.e. it is unclear what the cases are. Appropriate correction is required. Claim Interpretation The following is a quotation of 35 U.S.C. 112(f): (f) Element in Claim for a Combination. – An element in a claim for a combination may be expressed as a means or step for performing a specified function without the recital of structure, material, or acts in support thereof, and such claim shall be construed to cover the corresponding structure, material, or acts described in the specification and equivalents thereof. The following is a quotation of pre-AIA 35 U.S.C. 112, sixth paragraph: An element in a claim for a combination may be expressed as a means or step for performing a specified function without the recital of structure, material, or acts in support thereof, and such claim shall be construed to cover the corresponding structure, material, or acts described in the specification and equivalents thereof. The claims in this application are given their broadest reasonable interpretation using the plain meaning of the claim language in light of the specification as it would be understood by one of ordinary skill in the art. The broadest reasonable interpretation of a claim element (also commonly referred to as a claim limitation) is limited by the description in the specification when 35 U.S.C. 112(f) or pre-AIA 35 U.S.C. 112, sixth paragraph, is invoked. As explained in MPEP § 2181, subsection I, claim limitations that meet the following three-prong test will be interpreted under 35 U.S.C. 112(f) or pre-AIA 35 U.S.C. 112, sixth paragraph: (A) the claim limitation uses the term “means” or “step” or a term used as a substitute for “means” that is a generic placeholder (also called a nonce term or a non-structural term having no specific structural meaning) for performing the claimed function; (B) the term “means” or “step” or the generic placeholder is modified by functional language, typically, but not always linked by the transition word “for” (e.g., “means for”) or another linking word or phrase, such as “configured to” or “so that”; and (C) the term “means” or “step” or the generic placeholder is not modified by sufficient structure, material, or acts for performing the claimed function. Use of the word “means” (or “step”) in a claim with functional language creates a rebuttable presumption that the claim limitation is to be treated in accordance with 35 U.S.C. 112(f) or pre-AIA 35 U.S.C. 112, sixth paragraph. The presumption that the claim limitation is interpreted under 35 U.S.C. 112(f) or pre-AIA 35 U.S.C. 112, sixth paragraph, is rebutted when the claim limitation recites sufficient structure, material, or acts to entirely perform the recited function. Absence of the word “means” (or “step”) in a claim creates a rebuttable presumption that the claim limitation is not to be treated in accordance with 35 U.S.C. 112(f) or pre-AIA 35 U.S.C. 112, sixth paragraph. The presumption that the claim limitation is not interpreted under 35 U.S.C. 112(f) or pre-AIA 35 U.S.C. 112, sixth paragraph, is rebutted when the claim limitation recites function without reciting sufficient structure, material or acts to entirely perform the recited function. Claim limitations in this application that use the word “means” (or “step”) are being interpreted under 35 U.S.C. 112(f) or pre-AIA 35 U.S.C. 112, sixth paragraph, except as otherwise indicated in an Office action. Conversely, claim limitations in this application that do not use the word “means” (or “step”) are not being interpreted under 35 U.S.C. 112(f) or pre-AIA 35 U.S.C. 112, sixth paragraph, except as otherwise indicated in an Office action. This application includes one or more claim limitations that do not use the word “means,” but are nonetheless being interpreted under 35 U.S.C. 112(f) or pre-AIA 35 U.S.C. 112, sixth paragraph, because the claim limitation(s) uses a generic placeholder that is coupled with functional language without reciting sufficient structure to perform the recited function and the generic placeholder is not preceded by a structural modifier. Such claim limitation(s) is/are: a device for generating a magnetic field as claimed in claim 1 and described on page 10 of the specification; and a device for tapping a measurement voltage in the medium as claimed in claim 1 and described on page 11 of the specification. Because this/these claim limitation(s) is/are being interpreted under 35 U.S.C. 112(f) or pre-AIA 35 U.S.C. 112, sixth paragraph, it/they is/are being interpreted to cover the corresponding structure described in the specification as performing the claimed function, and equivalents thereof. If applicant does not intend to have this/these limitation(s) interpreted under 35 U.S.C. 112(f) or pre-AIA 35 U.S.C. 112, sixth paragraph, applicant may: (1) amend the claim limitation(s) to avoid it/them being interpreted under 35 U.S.C. 112(f) or pre-AIA 35 U.S.C. 112, sixth paragraph (e.g., by reciting sufficient structure to perform the claimed function); or (2) present a sufficient showing that the claim limitation(s) recite(s) sufficient structure to perform the claimed function so as to avoid it/them being interpreted under 35 U.S.C. 112(f) or pre-AIA 35 U.S.C. 112, sixth paragraph. Claim Rejections - 35 USC § 112 The following is a quotation of 35 U.S.C. 112(b): (b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention. The following is a quotation of 35 U.S.C. 112 (pre-AIA ), second paragraph: The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention. Claims 25, 27, 29, 32, 36 and 38 are rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant), regards as the invention. Claim 25 recites the limitation "the time intervals" in line 2. There is insufficient antecedent basis for this limitation in the claim; i.e. it is unclear what the time intervals are. Claim 27 recites the limitation "the time intervals" in line 2. There is insufficient antecedent basis for this limitation in the claim; i.e. it is unclear what the time intervals are. Claim 29 recites the limitation "in each case" in line 1. There is insufficient antecedent basis for this limitation in the claim; i.e. it is unclear what the cases are. Claim 32 recites the limitation "in each case" in line 1. There is insufficient antecedent basis for this limitation in the claim; i.e. it is unclear what the cases are. Regarding claim 36, the phrase "in particular once" renders the claim indefinite because it is unclear whether the limitation(s) following the phrase are part of the claimed invention. See MPEP § 2173.05(d). Claim 38 recites “a device for generating a magnetic field” in line 3 and “a device for tapping a measurement voltage” in line 4. However, claim 20, on which claim 38 depends, already recites these limitations. Therefore, it is unclear whether or not the limitations in claim 38 are new structures or if they are the same structures recited in claim 20. Claim Rejections - 35 USC § 102 In the event the determination of the status of the application as subject to AIA 35 U.S.C. 102 and 103 (or as subject to pre-AIA 35 U.S.C. 102 and 103) is incorrect, any correction of the statutory basis (i.e., changing from AIA to pre-AIA ) for the rejection will not be considered a new ground of rejection if the prior art relied upon, and the rationale supporting the rejection, would be the same under either status. The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action: A person shall be entitled to a patent unless – (a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale, or otherwise available to the public before the effective filing date of the claimed invention. Claims 20 and 38 are rejected under 35 U.S.C. 102(a)(1) as being anticipated by U.S. Patent 7,260,486 issued to Budmiger (“Budmiger”). As for claim 20, Budmiger discloses a method for operating a magnetic-inductive flowmeter for determining a flow rate-dependent measured variable of a flowable medium, wherein the magnetic-inductive flowmeter comprises a device (1) for generating a magnetic field and a device (implied) for tapping a measurement voltage in the medium, the method comprising: applying (Fig. 5b) a first voltage signal to the device for generating the magnetic field, wherein the first voltage signal defines a first voltage curve (Fig. 5b), which is variable over time and which is divided into first time intervals (ta and tc), wherein: the first time intervals each have a first time subinterval (tc), in which a first voltage (UC), which is constant over the entire first time subinterval, is applied to the device for generating the magnetic field; the first time intervals each have at least one measurement interval (tc) in which a coil current (see Fig. 5a) flows through the device for generating the magnetic field; the first voltage is controlled such that a difference between the coil current (I) and a predetermined coil current setpoint value (Im) is minimized during the measurement interval (col. 9, lines 26-32); and the coil current setpoint value is constant for the entire first voltage signal (see Fig. 5a); and applying a second voltage signal (Fig. 5b) to the device for generating the magnetic field, wherein the second voltage signal defines a second voltage curve (Fig. 5b), which is variable over time and which is divided into second time intervals (subsequent ta and tc), wherein the second time intervals each have a second time subinterval (tc), in which a second voltage (Ucont), which is constant over the entire second time subinterval, is applied to the device for generating the magnetic field, and wherein the second voltage is controlled such that a difference between a control function (I) and a control setpoint value (Im), which includes a variable (i.e. current) proportional to a magnetic flux, is minimized (col. 9, lines 26-32). As for claim 38, Budmiger discloses a magnetic-inductive flowmeter for determining a flow rate-dependent measured variable for a flowable medium, the magnetic-inductive flowmeter comprising: a device for generating a magnetic field (1); a device (implied) for tapping a measurement voltage in the medium; and an operating circuit is configured to perform the method according to claim 20 (see the rejection of claim 20 above). Allowable Subject Matter Claims 21-24, 26, 28, 30, 31, 33-35 and 37 are objected to as being dependent upon a rejected base claim, but would be allowable if rewritten in independent form including all of the limitations of the base claim and any intervening claims. Claims 25, 27, 29, 32 and 36 would be allowable if rewritten to overcome the rejection(s) under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), 2nd paragraph, set forth in this Office action and to include all of the limitations of the base claim and any intervening claims. Conclusion The prior art made of record and not relied upon is considered pertinent to applicant's disclosure. U.S. Patent 7,260,486 issued to Budmiger is cited for all that it discloses including a method for operating a magnetic-inductive flowmeter that includes applying a voltage signal that includes multiple voltages.
