Office Action

§112
DETAILED ACTION Notice of Pre-AIA or AIA Status The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . This office action is in response to applicant’s communication of 6/3/2024. Currently claims 1-12 are pending. Claims 1-2 are rejected and claims 3-12 are objected below. Claim Objections There are two sets of claims submitted on 6/3/2024. One set contains only claim 1 and the other set contains claims 1-12 from the PCT. Examiner advises applicant to submit a complete set of claims and the status of the claims as appropriate. Claims 3-12 are objected to under 37 CFR 1.75(c) as being in improper form because a multiple dependent claim 3. See MPEP § 608.01(n). Accordingly, the claims 3-12 have not been further treated on the merits. Claim Rejections - 35 USC § 112 The following is a quotation of 35 U.S.C. 112(b): (b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention. The following is a quotation of 35 U.S.C. 112 (pre-AIA ), second paragraph: The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention. Claims 1-2 are rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant), regards as the invention. Regarding claim 1, the phrase "the needle comprises a first attachment element at its proximal side of the base plate" renders the claim indefinite because it is unclear whether the “first attachment element” is on the “needle” or the “base plate”. Appropriate correction is required. The closest prior art appears to be: US 2019/0160261 A1 (Vanderstek) US 2008/0269695 A1 (Perouse et al.) US 2005/0049553 A1 (Triplett et al.) US 7,776,016 B1 (Halseth et al.) However each of these appears to not disclose the “second attachment element” on the connection hub.
