Notice of Pre-AIA or AIA Status
The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA .
DETAILED ACTION
Response to Amendment
Applicant’s amendment, filed 07/22/2026, has been entered and carefully considered. Claims 1, 2, 4, 5, 7, 8, 10, 12-16, 37, 38, 41, and 43 are pending, with claims 1, 7, and 12 being independent. Claims 1, 7, and 12 are amended. Claims 3, 6, 9, 11, 17-36, 39, 40, and 42 are canceled.
Response to Arguments
Applicant’s arguments with respect to claim(s) 1, 2, 4, 5, 7, 8, 10, 12-16, 37, 38, 41, and 43 have been considered but are moot because the new ground of rejection does not rely on any reference applied in the prior rejection of record for any teaching or matter specifically challenged in the argument.
Claim Rejections - 35 USC § 112
The following is a quotation of 35 U.S.C. 112(b):
(B) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention.
The following is a quotation of 35 U.S.C. 112 (pre-AIA ), second paragraph:
The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention.
Claims 1, 2, 4, 5, 7, 8, 10, 12-16, 37, 38, 41, and 43are rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor, or for pre-AIA the applicant regards as the invention.
Regarding claims 1, 7 and 12, claims 1, 7 and 12 recite as “receiving first configuration information sent by a core network device; wherein the first configuration information is configured to determine first measurement gap configuration information, and the first measurement gap configuration information is used to configure a measurement gap for a terminal device; wherein the first configuration information comprises positioning reference signal (PRS) configuration information and measurement gap configuration information, the measurement gap configuration information comprises at least one of a period of an offset parameter of at least one measurement gap; wherein receiving the first configuration information sent by the core network device comprises: receiving an NRPPa message sent by the core network device, wherein the NRPPa message comprises the first configuration information, is considered indefinite. As initially its defined in claim that wherein the first configuration information comprises positioning reference signal (PRS) configuration information and measurement gap configuration information and later in claim its defined that the first configuration information comprises an NRPPa message which comprises first configuration information, which is indefinite. Examiner recommends to review specifications to define the information contained in the NRPPa message.
An appropriate correction is required in all independent claims.
Conclusion
The prior art made of record and not relied upon is considered pertinent to applicant's disclosure:
LIU et al. (US 2022/0116902 A1) discloses methods, devices, apparatuses and computer readable storage media for uplink (UL) positioning of idle or inactive terminal device. In example embodiments, a location management functionality determines a configuration related to an uplink positioning reference signal for a terminal device in an idle or inactive state. The location management functionality indicates the configuration to a location measurement unit. Further, the location management functionality causes a base station to inform the terminal device of the configuration via a paging message to trigger uplink positioning of the terminal device based on the configuration while the terminal device is in the idle or inactive state, or to release the uplink positioning while the terminal device is in the idle or inactive state.
Applicant's amendment necessitated the new ground(s) of rejection presented in this Office action. Accordingly, THIS ACTION IS MADE FINAL. See MPEP § 706.07(a). Applicant is reminded of the extension of time policy as set forth in 37 CFR 1.136(a).
A shortened statutory period for reply to this final action is set to expire THREE MONTHS from the mailing date of this action. In the event a first reply is filed within TWO MONTHS of the mailing date of this final action and the advisory action is not mailed until after the end of the THREE-MONTH shortened statutory period, then the shortened statutory period will expire on the date the advisory action is mailed, and any nonprovisional extension fee (37 CFR 1.17(a)) pursuant to 37 CFR 1.136(a) will be calculated from the mailing date of the advisory action. In no event, however, will the statutory period for reply expire later than SIX MONTHS from the mailing date of this final action.
