DETAILED ACTION Notice of Pre-AIA or AIA Status The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . Information Disclosure Statement The information disclosure statement (IDS) submitted on 6/28/2024 was filed in compliance with the provisions of 37 CFR 1.97. Accordingly, the information disclosure statement is being considered by the examiner. Claim Rejections - 35 USC § 102 In the event the determination of the status of the application as subject to AIA 35 U.S.C. 102 and 103 (or as subject to pre-AIA 35 U.S.C. 102 and 103) is incorrect, any correction of the statutory basis (i.e., changing from AIA to pre-AIA ) for the rejection will not be considered a new ground of rejection if the prior art relied upon, and the rationale supporting the rejection, would be the same under either status. The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action: A person shall be entitled to a patent unless – (a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale, or otherwise available to the public before the effective filing date of the claimed invention. 1: Claim(s) 1, 4, 13 and 14 is/are rejected under 35 U.S.C. 102(a)(1) as being anticipated by CN 113780090 A Yuan et al (for examination purposes the examiner has relied upon the provided English translation). 2: As for Claim 1, Yuan et al teaches in the abstract and on Pages 2-4 A data processing device comprising: a security processing unit (the system performs facial recognition for security purposes to enable users to gain access if the face is matched in order to unlock a device) configured to perform security processing for each group (facial recognition is performed on the detected faces) including designated data among a plurality of types of data (different detected faces) for one frame obtained from a sensor chip (ToF image sensor); and a transmission unit configured to frame data acquired by the security processing (framed ToF image data is generated and transmitted by the facial recognition system) by the security processing unit (facial recognition and matching processing) and transmit the data to a host device. 3: As for Claim 4, Yuan et al teaches on Page 10 first paragraph wherein the security processing unit performs processing of encrypting the data of each group. 4: As for Claim 13, Claim 13 is rejected for reasons discussed related to Claim 1. 5: As for Claim 14, Claim 14 is rejected for reasons discussed related to Claim 1. Allowable Subject Matter Claims 2, 3 and 5-12 are objected to as being dependent upon a rejected base claim, but would be allowable if rewritten in independent form including all of the limitations of the base claim and any intervening claims. Conclusion The prior art made of record and not relied upon is considered pertinent to applicant's disclosure. CN 113807172 B teaches a system that uses facial recognition and ToF data to perform human face security.
