Claim Rejections - 35 USC § 112
The following is a quotation of 35 U.S.C. 112(b):
(b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention.
The following is a quotation of 35 U.S.C. 112 (pre-AIA ), second paragraph:
The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention.
Claims 1-3 and 7 are rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant), regards as the invention. Claim 1 recites that “a tensile stress existence rate which is a rate of a part which exists in a non-single period…” which is indefinite because it is unclear as to what structure this required. Specifically, it is unclear whether the “period” refers to a particular location or feature of the steel or magnetic domain image of said steel, or whether “non-single period” refers to multiple instances of said tensile stress, or something else entirely.
Conclusion
The prior art made of record and not relied upon is considered pertinent to applicant's disclosure:
Kawamura et al. (JP2020169373, machine translation referred to herein) and Kataoka et al. (US 2021/0043345) are directed to strains/stresses applied to electrical grain-oriented steel sheets to optimize control of magnetic domains and improve properties; however, these references do not teach the claimed stress existence rates in the claimed regions.
