Notice of Pre-AIA or AIA Status
The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . In the event the determination of the status of the application as subject to AIA 35 U.S.C. 102 and 103 (or as subject to pre-AIA 35 U.S.C. 102 and 103) is incorrect, any correction of the statutory basis (i.e., changing from AIA to pre-AIA ) for the rejection will not be considered a new ground of rejection if the prior art relied upon, and the rationale supporting the rejection, would be the same under either status.
Specification
The disclosure is objected to because of the following informalities:
Applicant cites Korean Registered Patent No. 10-1524417 on p. 1 but later erroneously refers to the same reference as Korean Registered Patent No. 10-15244416 on p. 2.
Appropriate correction is required.
Claim Rejections - 35 USC § 112
The following is a quotation of 35 U.S.C. 112(b):
(b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention.
Claim 2 is rejected under 35 U.S.C. 112(b) as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor regards as the invention. Claim 2 recites a pretreatment step which includes “removing dust from the fabric in a rolled state” and “simultaneously rolling the dust-removed fabric.” These two operations are mutually exclusive and unclear. Removing dust from the fabric in a rolled state requires that the fabric be rolled prior to dust removal, while simultaneous rolling and dust removal require that the fabric be in an unrolled state during dust removal if the fabric is a “dust-removed” fabric during the rolling. Therefore one of ordinary skill in the art is not reasonably apprised of the metes and bounds of the claim. For examination purposes, the claim has been construed as reciting a step of removing dust from a fabric in a rolled state, which is consistent with claim 1.
Allowable Subject Matter
Claims 1 and 3-7 are allowed.
As of the date of this Notice of Allowability, the Examiner has not identified any reference which anticipates the instantly claimed invention or any combination of references which renders the instantly claimed invention obvious to one of ordinary skill in the art. The method of claim 1 requires a step of pretreating a fabric while in a rolled state and laminating the pretreated fabric to Korean paper. While fabric treatments are generally known in the prior art, they are not performed on a rolled fabric while it is in a rolled state prior to lamination with Korean paper. Fabrics are conventionally unrolled and treated in a flat state rather than being pretreated in a rolled state as claimed. Korean paper manufacturing and lamination methods are generally known, however there is no teaching or suggestion in the prior art which would have led one of ordinary skill in the art at the time of filing to pretreat a fabric in a rolled state and subsequently laminate the pretreated fabric to Korean paper.
