This is a Non-final action for application number 18/672,110 in response to an original application filed on 05/23/2024.
Claims 1-3, 5, 7-10, 13 and 52-62 are pending and considered below.
Claims 4, 6, 11, 12 and 14-51 have been cancelled.
Claims 1, 52 and 59 are independent claims.
Information Disclosure Statement
The information disclosure statement (IDS), submitted on 07/03/2024, is in compliance with the provisions of 37 CFR 1.97. Accordingly, the information disclosure statement is being considered by the examiner.
Claim Rejections - 35 USC § 103
The following is a quotation of pre-AIA 35 U.S.C. 103(a) which forms the basis for all obviousness rejections set forth in this Office action:
A patent may not be obtained though the invention is not identically disclosed or described as set forth in section 102 of this title, if the differences between the subject matter sought to be patented and the prior art are such that the subject matter as a whole would have been obvious at the time the invention was made to a person having ordinary skill in the art to which said subject matter pertains. Patentability shall not be negatived by the manner in which the invention was made.
Claims 1-3, 5, 7-9, 13 and 52-57, 59-62 are rejected under pre-AIA 35 U.S.C. 103 as being unpatentable over IANEV et al. (US 2022/0039046 A1) herein Chaudhuri et al. in view of GUPTA et al. (US 2022/0263832 A1)
Regarding claims 1, 52 and 59, a method for delivery of user consent information within a network, comprising:
an access and mobility management function (AMF) of the network, obtaining, from a user data management (UDM) user consent information, [NAS User Consent Update (UE_Id, analytics consent bitmap)—The UE analytics consent information (per a single type of analytics data or per set of analytics data, depending on what types of analytics data the UE 30 is subscribed to) is provided to the AMF 71 (e.g. at location update procedure e.g. via Nudm_SDM_Get/Response procedure or any other procedure name where the AMF 71 retrieves the UE subscription information for UE analytics data collection and reporting and also retrieves the user consent from the UDM/UDR 75), (Ianev et al., Paragraph 162)],
and providing, to a base station of the network, the user consent information, [the UE consent information can also be provided to the (R)AN node 50, via the AMF 71 for example, for the analytics data that is collected by the ((R)AN) node, (Ianev et al., Paragraph 163)], via a user consent information element, [If a condition for the reporting is met, then the UE 30 sends the UE Analytics information message to the AMF 71. The UE 30 includes the UE analytics report information element in the UE Analytics information message, (Ianev et al., Paragraph 147)],
Ianev et al. fails to explicitly teaches via a user consent parameter included in a structured data type,
Gupta et al. teaches that the user voluntarily provides an updated user consent to the edge enabler client 100 for sending the user consent update request to the server 500. The user consent update request includes information about at least one parameter of the user consent to be updated. Examples for the parameter of the user consent are the number of times the user consent is allowed to use, a time-bound or a location (such as geo-location) bound, (Gupta et al., Paragraph 75),
It would have been obvious to one of ordinary skill in the art at the time of the invention was made to modify Ianev et al. fails by including via a user consent parameter included in a structured data type, (Gupta et al., Paragraph 75), in order to obtain a user consent for providing a service to an edge application, (Gupta et al., Paragraph 6).
Regarding claim 2, the method of claim 1, wherein the structured data type is an AccessAndMobilitySubscriptionData, [As in step 1 the network operator provides the UE Id for which user consent is applicable and the user consent itself within the UE analytics consent bitmap parameter which is stored in the UDM/UDR 75 as a subscription information, (Ianev et al., Paragraph 161)].
Regarding claims 3 and 53, the method wherein the user consent parameter is associated with at least one data type and wherein the at least one data type includes at least one of: connection error failure (CEF) report information sharing consent; radio link failure (RLF) report information sharing consent; or user location information sharing consent, [Based on the requested type(s) of the statistics data to be collected and reported, the UE 30 may: [0165] simply monitor events that are happening in the UE 30 and visible to the UE 30 (e.g. cell reselections, battery power level, number of link failures and etc.), store the statistics for these events and report them based on the trigger conditions defined by the network in analytics information to be collected information element in step 4 of FIG. 1, (Ianev et al., Paragraph 165)].
Regarding claims 5 and 54, the method wherein the user consent parameter is a one-dimensional array of values, [The user consent update request includes information about at least one parameter of the user consent to be updated. Examples for the parameter of the user consent are the number of times the user consent is allowed to use, a time-bound or a location (such as geo-location) bound, (Gupta et al., Paragraph 75)], and wherein each element of the one-dimensional array of values is associated with a Public Land Mobile Network (PLMN) identifier, [This procedure can be used for both Home PLMN and Visited PLMN for the Mobile terminal analytics information collection. The AF 12 or the NWDAF 72 in the Solution 3 can be owned by Home PLMN operator, Visited PLMN operator or 3rd party, (Ianev et al., Paragraph 132)].
Regarding claims 7 and 55, the method wherein the user consent information is per Public Land Mobile Network (PLMN), [This procedure can be used for both Home PLMN and Visited PLMN for the Mobile terminal analytics information collection. The AF 12 or the NWDAF 72 in the Solution 3 can be owned by Home PLMN operator, Visited PLMN operator or 3rd party, (Ianev et al., Paragraph 132)].
Regarding claims 8 and 56, the method wherein the user consent information-parameter is a Boolean value, [The user consent update request includes information about at least one parameter of the user consent to be updated. Examples for the parameter of the user consent are the number of times the user consent is allowed to use, a time-bound or a location (such as geo-location) bound, (Gupta et al., Paragraph 75)].
Regarding claims 9 and 57, the method of claim 1, wherein the user consent information-parameter is an Enumerated value, [The user consent update request includes information about at least one parameter of the user consent to be updated. Examples for the parameter of the user consent are the number of times the user consent is allowed to use, a time-bound or a location (such as geo-location) bound, (Gupta et al., Paragraph 75)].
Regarding claim 13, the method of claim 10, wherein the type of information includes one or more of: radio link failure (RLF) information sharing consent or user location information sharing consent, [Based on the requested type(s) of the statistics data to be collected and reported, the UE 30 may: [0165] simply monitor events that are happening in the UE 30 and visible to the UE 30 (e.g. cell reselections, battery power level, number of link failures and etc.), store the statistics for these events and report them based on the trigger conditions defined by the network in analytics information to be collected information element in step 4 of FIG. 1, (Ianev et al., Paragraph 165)].
Regarding claim 60, the non-transitory computer readable memory medium of claim 59, wherein the instructions executable by the processing circuitry to perform operations comprising providing, to the base station of the network, the user consent information via the user consent information element further include instructions executable by the processing circuitry to perform operations comprising:
providing the user consent information via an initial context setup request message sent to the base station of the network, wherein the user consent information element is included in the initial context setup request message, [Ianev et al., Figure 4, Steps 1-5]
Regarding claim 61, the non-transitory computer readable memory medium of claim 59, wherein the instructions executable by the processing circuitry to perform operations comprising providing, to the base station of the network, the user consent information via the user consent information element further include instructions executable by the processing circuitry to perform operations comprising:
providing the user consent information via a user equipment, UE, context modification request message sent to the base station of the network, wherein the user consent information element is included in the UE context modification request message, [Ianev et al., Figure 4, Steps 1-5].
Regarding claim 62, the non-transitory computer readable memory medium of claim 59, wherein the instructions executable by the processing circuitry to perform operations comprising providing, to the base station of the network, the user consent information via the user consent information element further include instructions executable by the processing circuitry to perform operations comprising:
providing the user consent information via a handover request message sent to the base station of the network, wherein the user consent information element is included in the handover request message, [receiving, by the server (500), a user consent update request from an application client (200) through an edge application server (700), wherein the user consent update request comprises information about at least one parameter of the user consent to be updated, (Gupta et al., Paragraph 40)].
Allowable Subject Matter
Claims 10 and 58 are objected to as being dependent upon a rejected base claim, but would be allowable if rewritten in independent form including all of the limitations of the base claim and any intervening claims.
