CTNF 18/726,826 CTNF 89232 DETAILED ACTION Notice of Pre-AIA or AIA Status 07-03-aia AIA 15-10-aia The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA. Priority Acknowledgment is made wherein this application is 371 of the PCT Application PCT/JP2023/000086, being filed on January 05, 2023. 02-27 Acknowledgment is made of applicant's claim for foreign priority under 35 U.S.C. 119(a)-(d). The certified copy has been filed in present Application filed on July 05, 2024. Information Disclosure Statement The information disclosure statements filed July 05,2024 have been submitted for consideration by the Office. It has been placed in the application file and the information referred to therein has been considered. Applicants must continue to submit prior art references throughout the patent application process. A supplemental IDS must be submitted if prior art is discovered through a foreign patent application or an International Patent Search, or a related application before a prosecution closes. Claim Rejections - 35 USC § 112 07-30-02 AIA The following is a quotation of 35 U.S.C. 112(b): (b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention. The following is a quotation of 35 U.S.C. 112 (pre-AIA), second paragraph: The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention. 07-34-01 Claims 1-5 are rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant), regards as the invention. Rejections of claims 1-5, in claims 1 and 3, it is not clear that a part “a part in an extension direction of the wiring member” refresh to what wiring member or else. Note that a steering rotation center axis is imaginary axis in the limitation “a part in an extension direction of the wiring member being fixed with rotation about a steering rotation center axis stopped at a rotation stopping/fixing position on the steering rotation center axis” and it does not exist without underlying essential structure (appears to be damper 37). Something can not be fixed on the steering rotation center axis; it is only used as reference point. Fixing member 60 fixed on upper and lower arms which stop rotation of wires; not on the steering rotation center axis or a damper 38. Proper clarification required. Claims 2, and 4-5 are rejected by the same reason applied above. 07-06 AIA 15-10-15 In the event the determination of the status of the application as subject to AIA 35 U.S.C. 102 and 103 (or as subject to pre-AIA 35 U.S.C. 102 and 103) is incorrect, any correction of the statutory basis (i.e., changing from AIA to pre-AlA) for the rejection will not be considered a new ground of rejection if the prior art relied upon, and the rationale supporting the rejection, would be the same under either status. Claim Rejections - 35 USC § 102 The following is a quotation of 35 U.S.C. 102 which forms the basis for all rejections set forth in this Office action: A person shall be entitled to a patent unless – 07-08-aia AIA (a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale, or otherwise available to the public before the effective filing date of the claimed invention. 07-12-aia AIA (a)(2) the claimed invention was described in a patent issued under section 151, or in an application for patent published or deemed published under section 122(b), in which the patent or application, as the case may be, names another inventor and was effectively filed before the effective filing date of the claimed invention. 07-15 AIA Claim s 1-5 are rejected under 35 U.S.C. 102( a)(1)/(a)(2) (whichever apply ) as being anticipated by JP2008-308033 (cited reference), or Ishikawa (US20190111747) or Tokuda (US20070234559) . Rejections of claims 1-2, JP2008 or Ishikawa or Tokuda discloses a suspension wiring module, comprising: a wiring member (claim 1) (see figures of JP2008 or see figures of Ishikawa or see figures of Tokuda) a wiring member for connecting a vehicle body-side device and a wheel-side device; a part in an extension direction of the wiring member being fixed with rotation about a steering rotation center axis stopped at a rotation stopping/fixing position on the steering rotation center axis (claim 1); wherein the wiring member is fixed at a position different from an extension of a damper (claim 2) ( only positive structure in claim is wiring member; limitation “for connecting a vehicle body-side device and a wheel-side device… wherein the wiring member is fixed at a position different from an extension of a damper” consider to be intended use; therefore do not get any patentable weight. “for” defines intended use; and same wire can be used or attached to other part of vehicles. Note that structure is what it is, not how is been used. Furthermore, see MPEP ). Rejections of claims 3-5, JP2008 or Ishikawa or Tokuda discloses a suspension wiring module, comprising: a wiring member; the wiring member including a first linear transmission member and a second linear transmission member (claim 1) (see figures of JP2008 or see figures of Ishikawa or see figures of Tokuda). a wiring member for connecting a vehicle body-side device and a wheel-side device; a part in an extension direction of the wiring member being fixed in a rotation stopped state at a rotation stopping/fixing position on a steering rotation center axis, end parts of the respective first and second linear transmission members on side of the wheel-side device being connected to a connector at mutually different positions, and a length of the first linear transmission member from the rotation stopping/fixing position to the wheel-side device being equal to a length of the second linear transmission member from the rotation stopping/fixing position to the wheel-side device; wherein the wiring member is fixed at a position different from an extension of a damper (claim 3); wherein the wiring member is fixed by a fixing member fixed to at least one of a damper, an upper arm and a lower arm at the rotation stopping/fixing position (claim 4); and wherein the extension direction of the wiring member to the steering rotation center axis is within range of +-30 degree(claim 5) ( only positive structure in claim is wiring member as mentioned above; limitation “for connecting a vehicle body-side device and a wheel-side device… the steering rotation center axis is within range of +-30 degree” considered to be intended use; “for” defines intended use, and same wire can be used or attached other part of vehicles. therefore do not get any patentable weight. Note that structure is what it is, not how is been used). Pertinent Prior Arts The prior arts made of record and not relied upon is considered pertinent to applicant's disclosure. Please refer to the enclosed PTO-892 form for the citation of pertinent arts in the present case, all of which disclose various Bus bars.
