CTNF 18/729,701 CTNF 79004 DETAILED ACTION Notice of Pre-AIA or AIA Status 07-03-aia AIA 15-10-aia The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA. Claim Rejections - 35 USC § 112 07-30-02 AIA The following is a quotation of 35 U.S.C. 112(b): (b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention. The following is a quotation of 35 U.S.C. 112 (pre-AIA), second paragraph: The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention. 07-34-01 Claims 1-10 are rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant), regards as the invention. The statement: “ A first communication device among the first communication device and a second communication device that are connected to each other …” recited in claim 1 is unclear. Figure 1 and paragraph [0019] show the communication device 1 comprises a first communication device 2 and a second communication device 3. Therefore, it is confusing w hat are meant by “ A first communication device among the first communication device and a second communication device that are connected to each other … ”. Further, the limitations: “ the first communication device comprising one or more memories …” is unclear. It is confusing what “ the first communication device” is . Claims 2-4 depend on claim 1 are rejected. Claims 7 and 9 are rejected because they recite similar limitations with claim 1. The preamble of claim 5: “A second communication device among a first communication device and the second communication device that are connected to each other via an interface…” is unclear. It is confusing what is meant by “A second communication device among a first communication device and the second communication device that are connected to each other ”. Claim 6 is rejected because it depend on claim 5. Claims 8 and 10 are rejected because they recite a similar preamble with claim 5.
