Claim Rejections - 35 USC § 102
In the event the determination of the status of the application as subject to AIA 35 U.S.C. 102 and 103 (or as subject to pre-AIA 35 U.S.C. 102 and 103) is incorrect, any correction of the statutory basis (i.e., changing from AIA to pre-AIA ) for the rejection will not be considered a new ground of rejection if the prior art relied upon, and the rationale supporting the rejection, would be the same under either status.
The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action:
A person shall be entitled to a patent unless –
(a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale, or otherwise available to the public before the effective filing date of the claimed invention.
Claim(s) 1-7 is/are rejected under 35 U.S.C. 102(a)(1) as being anticipated by Taylor (US Pub. No.: 2016/0290534 A1) (hereinafter Taylor).
Regarding claim 1, Taylor anticipates an apparatus for transporting a fluid, comprising: a compressed thermoplastic pipe with an outer surface (Fig. 1, RC 1); and a first fiber tape layer surrounding the circumference of the pipe for substantially all of a length of the pipe (Fig. 1, RC 10); wherein the first fiber tape layer has continuous taut fibers and is melted into the outer surface (Fig. 1; ¶0026).
Regarding claim 2, Taylor anticipates wherein the pipe is made of one of: high-density polyethylene, polypropylene, and polyvinylidene fluoride (¶0025).
Regarding claim 3, Taylor anticipates wherein the continuous taut fibers include continuous uni-directional fiberglass fibers (¶0025).
Regarding claim 4, Taylor anticipates further comprising a second fiber tape surrounding the first fiber tape (Fig. 4, ¶0028).
Regarding claim 5, Taylor anticipates where in the first fiber tape and second fiber tape are comprised of polyethylene material (¶0025, ¶0038).
Regarding claim 6, Taylor anticipates further comprising a layer of UV protective film disposed on the second fiber tape layer (¶0028-¶0029).
Regarding claim 7, Taylor anticipates further comprising a layer of abrasion resistant film disposed on the second fiber tape layer (¶0029).
