Notice of Pre-AIA or AIA Status
The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA .
Specification
The title of the invention is not descriptive. A new title is required that is clearly indicative of the invention to which the claims are directed.
The following title is suggested: ELECTRICAL CONNECTOR HAVING A FERRULE FOR A PLURALITY OF ELECTRICAL WIRES.
Claim Rejections - 35 USC § 112
The following is a quotation of 35 U.S.C. 112(b):
(b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention.
The following is a quotation of 35 U.S.C. 112 (pre-AIA ), second paragraph:
The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention.
Claim 10 is rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant), regards as the invention.
Claim 10, lines 9-10 recite a second step where a plurality of first electric wires being disposed in the plurality of first disposition grooves and guiding the plurality of first electric wires to the front-end surface. Then claim 10, line 11 recites, “a third step of inverting the ferrule”. In view of the second and third steps, it is not clear and indefinite how the plurality of first electric wires is kept within the plurality of first disposition grooves without falling out. Furthermore, claim 10, lines 14-15 recite a fifth step reciting a first lid member being disposed on the first disposition surface to cover the plurality of first electric wires. Therefore, it seems that the third step and the fifth step should change the places with each other.
Claim Rejections - 35 USC § 102
In the event the determination of the status of the application as subject to AIA 35 U.S.C. 102 and 103 (or as subject to pre-AIA 35 U.S.C. 102 and 103) is incorrect, any correction of the statutory basis (i.e., changing from AIA to pre-AIA ) for the rejection will not be considered a new ground of rejection if the prior art relied upon, and the rationale supporting the rejection, would be the same under either status.
The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action:
A person shall be entitled to a patent unless –
(a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale, or otherwise available to the public before the effective filing date of the claimed invention.
Claim(s) 1 is/are rejected under 35 U.S.C. 102(a)(1) as being anticipated by Long et al (US 5,281,762).
Long discloses an electrical connector 36 comprising: a ferrule 60 including a front-end surface 72 intersecting a first direction (not labeled, see Fig. 7), a first disposition surface parallel to the first direction, and a plurality of first disposition grooves 74 extending along the first direction and formed on the first disposition surface in such a manner as to be arranged along a second direction intersecting the first direction; a plurality of first electric wires 12 disposed in the plurality of first disposition grooves 74; and a first lid member 62 disposed on the first disposition surface, wherein the first lid member 62 covers the plurality of first electric wires 12 disposed in the plurality of first disposition grooves 74.
Allowable Subject Matter
Claims 2-9 are objected to as being dependent upon a rejected base claim, but would be allowable if rewritten in independent form including all of the limitations of the base claim and any intervening claims.
Claim 10 would be allowable if rewritten or amended to overcome the rejection(s) under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), 2nd paragraph, set forth in this Office action.
