Claim Rejections - 35 USC § 102
The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action:
A person shall be entitled to a patent unless –
(a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale or otherwise available to the public before the effective filing date of the claimed invention.
(a)(2) the claimed invention was described in a patent issued under section 151, or in an application for patent published or deemed published under section 122(b), in which the patent or application, as the case may be, names another inventor and was effectively filed before the effective filing date of the claimed invention.
Claims 1-3 are rejected under 35 U.S.C. 102(a)(1) as being anticipated by US Patent No. 6375290 (“Lin et al.”).
Regarding Claims 1-3, Lin et al. CLAIM 1- discloses (refer to generic Fig.1-7) a slide rail assembly, comprising: a first rail (2); a second rail (1) movable relative to the first rail (2); a handle (33) movable relative to the second rail (1) to be in a first state or a second state; an auxiliary member (22) arranged on the second rail (1); and an elastic feature (34); wherein when the second rail (1) is located at a retracted position relative to the first rail (2), the auxiliary member (22) is configured to abut against the first rail (2) to be located at a first auxiliary position relative to the second rail (1), and the elastic feature (34) is configured to accumulate a predetermined elastic force; wherein when the handle (33) is moved to switch from the first state to the second state, the second rail (1) is movable from the retracted position to a predetermined extended position along an opening direction; wherein when the second rail (1) is located at the predetermined extended position relative to the first rail (2), the elastic feature (34) is configured to release the predetermined elastic force to the auxiliary member (22), such that the auxiliary member (22) is driven to move from the first auxiliary position to a second auxiliary position relative to the second rail (1) to be engaged with the handle (33) in order to hold the handle (33) in the second state; CLAIM 2-wherein when the second rail (1) returns to the retracted position from the predetermined extended position along a retracting direction, the auxiliary member (22) is configured to abut against the first rail (2) again to be moved from the second auxiliary position to return to the first auxiliary position relative to the second rail (1), such that the elastic feature (34) is configured to accumulate the predetermined elastic force, and the auxiliary member (22) is no longer engaged with the handle (33) to allow the handle (33) to return to the first state from the second state; CLAIM 3- an elastic member (34); wherein the handle (33) is configured to return to the first state from the second state in response to an elastic force of the elastic member (34).
Claims 1-6 and 8-9 are rejected under 35 U.S.C. 102(a)(1) as being anticipated by US 20200253082 (“YU et al.”).
Regarding Claims 1-6 aand 8-9, CLAIM 1-YU et al. discloses (refer to generic Fig.1-9C) a slide rail assembly, comprising:
a first rail (120); a second rail (400) movable relative to the first rail (120);
a handle (520, 521, 523) movable relative to the second rail (400) to be in a first state or a second state; an auxiliary member (810, 811, 830) arranged on the second rail (400); and an elastic feature (820); wherein when the second rail (400) is located at a retracted position relative to the first rail (120), the auxiliary member (810, 811, 830) is configured to abut against the first rail (120) to be located at a first auxiliary position relative to the second rail (400), and the elastic feature (820)is configured to accumulate a predetermined elastic force; wherein when the handle (520, 521, 523) is moved to switch from the first state to the second state, the second rail (400) is movable from the retracted position to a predetermined extended position along an opening direction; wherein when the second rail (400) is located at the predetermined extended position relative to the first rail (120), the elastic feature (820)is configured to release the predetermined elastic force to the auxiliary member (810, 811, 830), such that the auxiliary member (810, 811, 830) is driven to move from the first auxiliary position to a second auxiliary position relative to the second rail (400) to be engaged with the handle (520, 521, 523) in order to hold the handle (520, 521, 523) in the second state; CLAIM 2-wherein when the second rail (400) returns to the retracted position from the predetermined extended position along a retracting direction, the auxiliary member (810, 811, 830) is configured to abut against the first rail (120) again to be moved from the second auxiliary position to return to the first auxiliary position relative to the second rail (400), such that the elastic feature (820) is configured to accumulate the predetermined elastic force, and the auxiliary member (810, 811, 830) is no longer engaged with the handle (520, 521, 523) to allow the handle (520, 521, 523) to return to the first state from the second state; CLAIM 3- an elastic member (700, 701); wherein the handle (520, 521, 523) is configured to return to the first state from the second state in response to an elastic force of the elastic member (700, 701); Claim 4-wherein the first rail (120) comprises a blocking part (140), and the slide rail assembly further comprises a locking member (514) movably mounted on the second rail (400); wherein when the second rail (400) is located at the retracted position relative to the first rail (120), the locking member (514) is configured to be blocked by the blocking part (140) in order to prevent the second rail (400) from being moved from the retracted position along the opening direction; Claim 5-further comprising an actuating member (613) movable relative to the second rail (400); wherein during a process of the handle (520, 521, 523) being moved to switch from the first state to the second state, the handle (520, 521, 523) is configured to drive the actuating member (613) to move to further move the locking member (514) to be no longer blocked by the blocking part (140), in order to allow the second rail (400) to be moved from the retracted position along the opening direction; Claim 6- further comprising a driving member (600) movable relative to the second rail (400); wherein during the process of the handle (520, 521, 523) being moved to switch from the first state to the second state, the handle (520, 521, 523) is configured to drive the actuating member (613) to move, and the actuating member (613) is configured to further drive the locking member (514) to move through the
driving member (600), such that the locking member (514) is no longer blocked by the blocking part (140), in order to allow the second rail (400) to be moved from the retracted position along the opening direction; Claim 8-wherein when the second rail (400) is moved from the predetermined extended position along the retracting direction to return to the retracted position, the auxiliary member (810, 811, 830) is configured to abut against the first rail (120) again to be moved from the second auxiliary position to return to the first auxiliary position relative to the second rail (400), such that the elastic feature (820)is configured to accumulate the predetermined elastic force, the auxiliary member (810, 811, 830) is no longer engaged with the handle (520, 521, 523), the handle (520, 521, 523) is configured to return to the first state from the second state in response to the elastic force of the elastic member (700, 701), and the locking member (514) is configured to be blocked by the blocking member (514) again in order to prevent the second rail (400) from being moved away from the retracted position; Claim 9-wherein the handle (523) is pivoted relative to the second rail (400) through a shaft member (553, as seen in Fig.8) , the second rail (400) has an outer side and an inner side opposite to each other, the outer side of the second rail (400) faces toward the first rail (120), the handle (523) comprises a first end, a second end and an operating section connected between the first end and the second end, and the shaft member (553) is arranged adjacent to the first end; wherein when the handle ( 523) is in the
second state, the operating section of the handle (523) is extended beyond the inner side of the second rail (400) by a predetermined distance.
