The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA .
Specification
The title of the invention is not descriptive. A new title is required that is clearly indicative of the invention to which the claims are directed.
The lengthy specification has not been checked to the extent necessary to determine the presence of all possible minor errors. Applicant’s cooperation is requested in correcting any errors of which applicant may become aware in the specification.
Claim Rejections - 35 USC § 112
The following is a quotation of 35 U.S.C. 112(b):
(b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention.
The following is a quotation of 35 U.S.C. 112 (pre-AIA ), second paragraph:
The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention.
Claim 15 is rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant), regards as the invention.
Claim 15, line 2, the limitation, “filler powder” is confusing. Is this the same filler powder of claim 1?
Allowable Subject Matter
Claims 1-14, and 16-20 are allowed.
Claim 15 would be allowable if rewritten to overcome the rejection(s) under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), 2nd paragraph, set forth in this Office action and to include all of the limitations of the base claim and any intervening claims.
The following is a statement of reasons for the indication of allowable subject matter: In combination with the other claim limitations, the prior art does not teach or suggest a multilayer ceramic capacitor wherein the electrically conductive resin layer is provided at each ridge portion of the multilayer body; the electrically conductive resin layer at the ridge portion has a film thickness of about 0.8 µm or more and about 8 µm or less; the electrically conductive resin layer includes a peeling region separated from the multilayer body at least in one of the extending portions; the peeling region extends from an end portion of the electrically conductive resin layer adjacent to a middle of the multilayer body in the length direction to before an end of the base electrode layer adjacent to the middle of the multilayer body in the length direction; and the peeling region has a dimension of about 5 um or more in the length direction (claim 1).
Conclusion
The prior art made of record and not relied upon is considered pertinent to applicant's disclosure.
